<br />trip, favor, service or anything of monetary valueJo a DSHS or HHSC official or <br />employee in connection with this Contract. <br /> <br />Section 11.05 Ineligibility to Receive the Contract. Pursuant to TEX. Gov'T. <br />CODE Section ~ 2155.004 and federal law, Contractor is ineligible to receive this <br />Contract if the Contract includes financial participation by a person who received <br />compensation from DSHS to participate in developing, drafting or preparing the <br />specifications, requirements, statement(s) of work or Solicitation Document on <br />which this Contract is based. Contractor certifies that neither Contractor, nor its <br />employees, nor anyone acting for the Contractor has received compensation from <br />DSHS for participation in the development, drafting or preparation of <br />specifications, requirements or statement(s) of work for this Contract or in the <br />Solicitation Document on which this Contract is based. Contractor further certifies <br />that the individual or business entity named in this Contract is not ineligible to <br />receive the specified Contract. Contractor acknowledges that this Contract may be <br />terminated and payment withheld if these certifications are inaccurate. <br /> <br />Section 11.06 Antitrust. Pursuant to 15 U.S.C.A. Sec. 1, et seq. and TEX. Bus. & <br />COMM. CODE Section ~ 15.01, et seq. Contractor certifies that neither Contractor, <br />nor anyone acting for the Contractor has violated the antitrust laws of this state or <br />federal antitrust laws, nor communicated directly or indirectly regarding the bid <br />with any competitor or any other person engaged in such line of business for the <br />purpose of substantially lessening competition in such line of business. <br /> <br />Section 11.07 Initiation and Completion of Work. Contractor certifies that it <br />shall initiate and complete the work under the Contract within the applicable time <br />frame prescribed in the Contract. <br /> <br />ARTICLE XII GENERAL BUSINESS OPERATIONS OF <br />CONTRACTOR. <br /> <br />Section 12.01 Board Training. If they have not already done so within the <br />preceding two (2) years, a majority of the board of directors of Contractor shall <br />review the Department's board training in the format provided by the Department <br />and shall verify in writing to the DSHS Contract Oversight and Support Section that <br />the review took place. Written verification shall be submitted no later than the end <br />of the first' quarter of the Contract and shall be in the form required by the <br />Department. This review shall be completed at least every two (2) years of <br />consecutive funding from the Department, except that each member of the <br />governing board of a Contractor that provides mental health services shall complete <br />the board training review initially and then annually. The training may be viewed <br />through the Contractor Board Training link on the DSHS website at <br />http://www.dshs.state.tx.us/contractor .shtm. <br /> <br />Section 12.02 Duty of Compliance. Contractor and its governing board, shall bear full responsibility for the integrity of the fiscal and programmatic management of <br />the organization.
