<br />Section 12.10 Reporting for Unit Rate and Fee For Service Contracts. <br />Contractor shall submit reports concerning unit rate and fee-for-service contracts to <br />the Department in accordance with the requirements stated in the Department's <br />Contractor's Financial Procedures Manual located at <br />http://www.dshs.state.tx.us/contracts. <br /> <br />Section 12.11 Historically Underutilized Businesses (HUBs). If Contractor was <br />not required to submit a HUB subcontracting plan and if subcontracting is permitted <br />under this Program Attachment, Contractor is encouraged to make a good faith <br />effort to consider subcontracting with HUBs as set forth in TEX. GOy'T CODE ch. <br />2161 and 1 TEX ADM. CODE ~ 111.12. Contractors may obtain a list of HUBs at <br />http://www.tboc.state.tx.us. If Contractor has filed a HUB subcontracting plan, the <br />plan is incorporated by reference in this Contract. If Contractor desires to make a <br />change in the plan, Contractor must obtain prior approval from the Department's <br />HUB Coordinator of the revised plan before proposed changes will be effective <br />under the Contract. Contractor agrees to make a good faith effort to subcontract <br />with HUBs during the performance of this Contract and will report HUB <br />subcontract activity to the Department's HUB Coordinator by the 15th day of each <br />month for the prior month's activity, if there was any such activity, in accordance <br />with 1 TEX. ADM CODE SIII.16(c). <br /> <br />Section 12.12 Buy Texas. Contractor shall purchase products and materials <br />produced in Texas when the products and materials are available at a price and time <br />comparable to products and materials produced outside of Texas as required by <br />TEX. GOY'T CODE S 2155.4441. <br /> <br />Section 12.13 Contracts with Subrecipient Subcontractors. Contractor may <br />enter into contracts with subrecipient subcontractors unless restricted or otherwise <br />prohibited in a specific Program Attachment(s). Prior to entering into an agreement <br />equaling $25,000 or twenty-five percent (25%) of a Program Attachment amount, <br />whichever is greater, Contractor shall obtain written approval from DSHS. <br />Contracts with subcontractors shall be in writing and include the following: <br /> <br />a) Name and address of all parties; <br /> <br />b) A detailed description of the services to be provided; <br /> <br />c) Measurable method and rate of payment and total amount of contract; <br />d) Clearly defined and executable termination clause; <br /> <br />e) Beginning and ending dates that coincide with the dates of the applicable <br />Program Attachment(s) or cover a term within the beginning and ending dates <br />of the applicable Program Attachment(s); <br /> <br />f) Access to inspect the work and the premises on which any work is performed, <br />in accordance with the Access and Inspection Article in these General <br />Provisions; and <br /> <br />General Provisions (Core Subrecipient 2008) <br /> <br />6/1212007 <br /> <br />21 <br /> <br />.," "_..,-~'_._-~-~--" ~-~ <br />-_._--_.~ <br />
