<br />(a) Name of Executive; <br />(b) Name of State Agency; <br />( c) Date of Separation from State Agency, if separated; <br />(d) Date of Employment with Contractor; and <br />(e) Other information as required by DSHS to comply with TEx. GOV'T. CODE ~ <br />669.003. <br /> <br />Section 13.22 Technology Accessibility. If performance under this Contract <br />includes the development, modification or maintenance of a website for DSHS or <br />for the public on behalf of DSHS, Contractor expressly acknowledges that state <br />funds may not be expended in connection with the purchase of an automated <br />information system unless that system meets certain statutory and regulatory <br />requirements relating to accessibility by persons with blindness, visual impairments, <br />visual accuity less than 20170, deafness, diminishing hearing, inability to speak or a <br />lack of fme motor control (collectively "affected persons"). Accordingly, <br />Contractor represents and warrants to DSHS that the technology provided to DSHS <br />for purchase is capable, either by virtue of features included within the technology <br />or because it is readily adaptable by use with other technology, of: <br /> <br />a. Providing equivalent access for effective use by affected persons; <br /> <br />b. Presenting information, including prompts used for interactive <br />communications, in formats intended for use by affected persons; and <br /> <br />c. Being integrated into networks for obtaining, retrieving, and disseminating <br />information used by affected persons. <br /> <br />For purposes of this section, the phrase "equivalent access" means a substantially <br />similar ability to communicate with or make use of the technology, either directly by <br />features incorporated within the technology or by other reasonable means such as <br />assistive devices or services that would constitute reasonable accommodations under <br />the Americans with Disabilities Act or similar state or federal laws. Examples of <br />methods by which equivalent access may be provided include, but are not limited to, <br />keyboard alternatives to mouse commands and other means of navigating graphical <br />displays, information retrieval provided in an enhanced auditory fashion, voice <br />commands, touch screen capacity, and customize display appearance. <br /> <br />ARTICLE XIV BREACH OF CONTRACT AND REMEDIES <br />FOR NON-COMPLIANCE. <br /> <br />Section 14.01 Actions Constituting Breach of Contract.
