<br />ARTICLE I. IN GENERAL <br /> <br />Sec. 26-1. Composition of department. <br /> <br />The police department of the City shall be <br />composed ofthe chief of police and sixty-three (63) <br />members classified as follows: <br /> <br />(1) One (1) assistant chief. <br /> <br />(2) Three (3) police lieutenants. <br /> <br />(3) Twelve (12) police sergeants. <br /> <br />(4) Four (4) police corporals. <br /> <br />(5) Forty-three (43) police privates. <br />(Code 1970, ~ 25-1; Ord. Appointment of assistant chief of <br />police. <br /> <br />In accordance with V.T.C.A., Local Government <br />Code, chapter 143, section 143.014, the chief of <br />police of the city shall, in accordance with the <br />aforesaid civil service law, appoint the individual <br />within the police department to serve as assistant <br />chief of police. <br />(Ord. Policemen to furnish transporta- <br />tion to and from work; excep- <br />tions. <br /> <br />Each member of the police department shall <br />furnish his own transportation to and from work, <br />except those policemen who are furnished with a <br />city car that they keep overnight, and except that, <br /> <br />Supp. No. 58 <br /> <br />POLICE <br /> <br />~ 26-4 <br /> <br />when any member of the police department is <br />called out on an emergency, the regular patrol <br />cars may transport him to and from his home. <br />(Code 1970, ~ 25-3) <br /> <br />Sec. 26-4. Arrests without warrant. <br /> <br />(a) Any police officer of the City may arrest an <br />offender, without a warrant, for any offense com- <br />mitted in his presence or within his view. Such <br />officer may also arrest, without warrant, when a <br />felony or breach of the peace has been committed <br />in the presence or within the view of a magistrate, <br />and such magistrate verbally orders the arrest of <br />the offender. <br /> <br />(b) In addition to the provisions of paragraph <br />(a) ofthis section any police officer ofthe City may <br />arrest without warrant: <br /> <br />(1) Persons found in suspicious places and <br />under circumstances which reasonably <br />show that such persons have been guilty <br />of some felony or breach of peace, or <br />threaten or are about to commit some <br />offense against the laws; <br /> <br />(2) Persons who the officer has probable cause <br />to believe have committed an assault re- <br />sulting in bodily injury to another person <br />and the officer has probable cause to be- <br />lieve that there is danger of further bodily <br />injury to that person; or <br /> <br />(3) Persons who the officer has probable cause <br />to believe have committed the offense <br />defined by V.T.C.A., Penal Code Section <br />25.08 (violation of court order), whether of <br />not the offense is committed in the pres- <br />ence of the officer. <br /> <br />(c) If necessary to verify an allegation of a <br />violation of a protective order, an officer shall <br />follow the procedures established under V.T.C.A., <br />Family Code Section 71.18, without leaving the <br />scene of the investigation if there is a possibility <br />of the further commission of family violence. <br />(Code 1970, ~ 25-4) <br />State law reference-Similar provisions, V.A.C.C.P. arts. <br />14.01(b)-14.03. <br /> <br />1549 <br />
