Acquisition Policies Act of 1970 (P.L. 91-646), relating to fair treatment of persons <br />displaced or whose property is acquired as a result of Federal or federally-assisted <br />programs; <br />r) Davis-Bacon Act (40 U.S.C. §§ 276a to 276a-7), the Copeland Act (40 <br />U.S.C. § 276c and 18 U.S.C. § 874), and the Contract Work Hours and Safety <br />Standards Act (40 U.S.C. §§ 327-333), regarding labor standards for federally- <br />assistedconstruction subagreements; <br />s) National Historic Preservation Act of 1966, § 106 (16 U.S.C. § 470), <br />Executive Order 11593, and the Archaeological and Historic Preservation Act of <br />1974 (16 U.S.C. §§ 469a-1 et seq.) regazding historic property to the extent <br />necessary to assist DSHS in complying with the Acts; <br />t) Financial and compliance audits in accordance with Single Audit Act <br />Amendments of 1996 and OMB Circular No. A-133, "Audits of States, Local <br />Governments, and Non-Profit Organizations;" and <br />u) requirements of any other applicable statutes, executive orders, regulations <br />and policies. <br />If this Contract is funded by a grant, additional requirements found in the Notice of <br />Grant Award are imposed on Contractor and incorporated herein by reference. <br />Section 1.08 General Provisions Applicable to Interagency and Interlocal <br />Contracts. Certain sections or portions of sections of these General Provisions shall <br />not apply to Contractors that are State agencies or units of local government; and <br />certain additional provisions shall apply to such Contractors. <br />a) The following sections or portions of sections of these General Provisions shall <br />not apply to interagency or interlocal contracts; <br />1) Hold Harmless; <br />2) Independent Contractor (delete the third sentence in its entirety; delete the <br />word "employees" in the fourth sentence; the remainder of the section applies); <br />3) Insurance and Bonding; <br />4) Liability Coverage; <br />5) Fidelity Bond; <br />6) Board Training; and <br />7) Historically Underutilized Businesses (Contractor, however, shall comply <br />with HUB requirements of other statutes and rules specifically applicable <br />to that entity). <br />b) The following additional provisions shall apply to interagency contracts: <br />1) This Contract is entered into pursuant to the authority granted and in <br />compliance with the provisions of the Interagency Cooperation Act, Gov. <br />Code Chapter 771. <br />2) The parties hereby certify that (1) the services specified are necessary and <br />essential for the activities that are properly within the statutory functions <br />and programs of the affected agencies of State government; (2) the <br />proposed arrangements serve the interest of efficient and economical <br />administration of the State goven~ment, and (3) the services, supplies or <br />materials contracted for are not required by Section 21 of Article 16 of the <br />General Provisions (Core Subrecipient 2008) 6/1212007 4 <br />
