RESOLUTION NO. 2007 -130 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS; AUTHORIZING AND APPROVING A TEXAS DEPARTMENT OF TRANSPORTATION AND KIAMICHI RAILROAD PROJECT AT THE RAILROAD CROSSING ON GRAHAM STREET BETWEEN 11TH NW AND 12TH NW; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the Texas Department of Transportation (TxDOT) and Kiamichi Railroad will be replacing the planking with concrete and installing signals and gates at the Graham Street railroad crossing between 11" Street NW and 12" Street NW; and, WHEREAS, the City Engineer has reviewed the plans for this proposed concrete crossing and recommends approval by the City Council; and, WHEREAS, the City of Paris will be responsible for maintaining the pavement markings and advance warning signs; and, WHEREAS, it is deemed in the best interest of the citizens of the City of Paris that the City Council approve said railroad improvement project, and the City Manager of the City of Paris should be authorized to execute the plans in the form attached hereto as Exhibit A, on behalf of the City of Paris; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, THAT: Section 1. The findings set out in the preamble to this resolution are hereby in all things approved. Section 2. The Texas Department of Transportation and Kiamichi Railroad project at the railroad crossing on Graham Street between 11' Street NW and 12" Street NW as more particularly described in Exhibit A attached hereto, be, and is hereby approved. Section 3. The City Manager of the City of Paris be, and he is hereby authorized to execute on behalf of the City of Paris the TxDOT Plans for said railroad project in the form shown on Exhibit A attached hereto. Section 3. This resolution shall be effective immediately upon passage.
