ORDINANCE N0. 2007-046 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING A SITE PLAN, AS AMENDED, FOR LOT 4, BLOCK 8, SPRINGLAKE ADDITION, CITY OF PARIS, LAMAR COUNTY, TEXAS, LOCATED IN A PLANNED DEVELOPMENT DISTRICT - RETAIL SHOPPING CENTER (PD-a), PREVIOUSLY ESTABLISHED BY ZONING ORDINANCE N0. 96-039; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on July 15,1996 the City Council of the City of Paris, Texas, enacted Ordinance No. 96-039, establishing a Planned Development District- RETAIL SHOPPING CENTER (PD-a) on Lot 4 Block 8, Springlake Addition, City of Paris, Lamar County, Texas, as more particularly described in the aforesaid ordinance (the "Property"); and, WHEREAS, the owner of the Property has submitted a site plan which was reviewed by City Staff and approved by the Planning and Zoning Commission at their public meeting on November 5, 2007; and WHEREAS, the site plan was brought before the City Council of the City of Paris, Texas on November 12, 2007 for review and consideration; and, WHEREAS, following review and discussion of the site plan by City Council, City Staff, and the Property Owner, the City Council approved the site plan subject to the Property Owner's agreement to increase the side yard set back along the north side of Lot 3, Block 8, Springlake Addition from one foot (1') to a minimum of five feet (5'); and elimination of the proposed driveway and exit to NE 28`" Street; and, WHEREAS, no building permit will be issued for the Property until a revised site plan, which includes the changes approved by City Council on November 12, 2007, is filed with the City Community Development Department, reviewed and approved by the City Engineer and Director of Community Development. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2.
