A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AUTHORIZING THE EXECUTION OF A 20 FOOT WATER LINE EASEMENT AND A 50 FOOT TEMPORARY CONSTRUCTION EASEMENT TO LAMAR COUNTY WATER SUPPLY DISTRICT WHICH CROSSES UNDER PART OF LAKE CROOK PROPERTY FORA 16 FOOTW ATERMAIN; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, on December 10,2007, a public hearing was held to receive input from citizens regarding a request from Lamar County Water Supply District for a 20 foot water line easement and a 50 foot temporary construction easement to install a 16" water line under a part of Lake Crook property as more particularly described in Exhibits A and B and depicted in Exhibit C attached hereto (the "Project"); and, WHEREAS, Lake Crook is a designated park and/or recreation area owned by the City of Paris; and, WHEREAS, according to testimony from representatives of Lamar County Water Supply District and the City Engineer, there is no feasible or prudent alternative available for locating the proposed 16" water line than under a portion of Lake Crook as more particularly described in Exhibits A & B attached hereto; and, WHEREAS, the Project has been designed so as to minimize any harm to Lake Crook and has been reviewed and accepted by the City Engineer. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the City Council of the City of Paris hereby finds and determines, based upon the testimony and information provided by Lamar County Water Supply District, City staff and citizens speaking at the public hearing that there is no reasonable or prudent alternative for locating the proposed 16" water line other than under a portion of Lake Crook as further described in Exhibits A and B attached hereto and that the Project has been planned and designed so as to minimize any harm to this portion of Lake Crook. Section 3. That the request from Lamar County Water Supply District for a 20 foot utility easement and a 50 foot temporary construction easement crossing under a part of Lake Crook property as described in Exhibits A and B attached hereto, be and is hereby approved. Section 4. That the Mayor of the City of Paris be, and he is hereby authorized and directed to execute the 20 foot water line easement and the 50 foot temporary construction easement from the City of Paris to Lamar County Water Supply District, substantially according to the documents attached hereto as Exhibits A and B. ..' r r''r ~_.
