RESOLUTION N0. 2007-143 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />TEXAS, APPROVING CHANGE ORDER NO.ONE AND AUTHORIZING <br />FINAL PAYMENT TO B. BRAY CONSTRUCTION FOR THE <br />CONSTRUCTION OF WASTEWATER SYSTEM IMPROVEMENTS FOR <br />THE TEXAS DEPARTMENT OF TRANSPORTATION PINE MILL ROAD <br />AND LOOP 286 NE GRADE SEPARATION PROJECT, PHASE II; MAKING <br />OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND <br />DECLARING AN EFFECTIVE DATE. <br />WHEREAS, on May 14, 2007, the City Council of the City of Paris passed Resolution No. <br />2007-053, awarding the contract for the Wastewater System Improvement Project -Phase 2 as a part <br />of the Texas Department of Transportation's Pine Mill Road 7 NE Loop 286 Grade Separation <br />Project, to B. Bray Construction; and, <br />WHEREAS, the City Engineer, Shawn Napier, acting as project engineer, recommends the <br />amendment of the contract for said project to reflect the final construction cost of the project and <br />providing for a net decrease of $10,000.00 in the contract price, for a total contract price of <br />$160,374.00 with a final payment amount being $16,037.40; and, <br />WHEREAS, the form of Change Order No. One, attached hereto as Exhibit A, and the final <br />payment in the amount of $16,037.40 should, in all things, be approved, and the Mayor of the City <br />of Paris should be authorized to execute said Change Order. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF PARIS, TEXAS: <br />Section 1. That the findings set out in the preamble of this resolution are hereby in all things <br />approved. <br />Section 2. That the form of Change Order No. One to the Contract for the Wastewater <br />System Improvement Project -Phase 2 as a part of the Texas Department of Transportation's Pine <br />Mill Road 7 NE Loop 286 Grade Separation Project, attached hereto as Exhibit A, to reflect the final <br />construction cost of the proj ect, and providing for a net decrease of $10,000.00 in the contract price, <br />for a total contract price of $160,374.00, and the final payment in the amount of $16,037.40 be, and <br />the same is hereby, approved. <br />Section 3. That the Mayor be, and he is hereby, authorized and directed to execute, on behalf <br />of the City of Paris, said Change Order No. One & Final Payment upon the terms and conditions and <br />in the form shown in Exhibit A, attached hereto. <br />Section 4. That this resolution shall be effective from and after the date of passage. <br />
