RESOLUTION N0. 2007-144 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, AUTHORIZING THE EXECUTION OF A 20 FOOT <br />WATER LINE EASEMENT AND A 50 FOOT TEMPORARY <br />CONSTRUCTION EASEMENT TO LAMAR COUNTY WATER SUPPLY <br />DISTRICT WHICH CROSSES UNDER PART OF LAKE CROOK <br />PROPERTY FORA 16 FOOT WATER MAIN; MAKING OTHER FINDINGS <br />AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN <br />EFFECTIVE DATE. <br />WHEREAS, on December 10, 2007, a public hearing was held to receive input from citizens <br />regarding a request from Lamar County Water Supply District fora 20 foot water line easement and <br />a 50 foot temporary construction easement to install a 16" water line under a part of Lake Crook <br />property as more particularly described in Exhibits A and B a,nd depicted in Exhibit C attached <br />hereto (the "Project"); and, <br />WHEREAS, Lake Crook is a designated park and/or recreation area owned by the City of <br />Paris; and, <br />WHEREAS, according to testimony from representatives of Lamar County Water Supply <br />District and the City Engineer, there is no feasible or prudent alternative available for locating the <br />proposed 16" water line than under a portion of Lake Crook as more particularly described in <br />Exhibits A & B and depicted in Exhibit C attached hereto; and, <br />WHEREAS, the Project has been designed so as to minimize any harm to Lake Crook and <br />has been reviewed and accepted by the City Engineer. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF PARIS, TEXAS: <br />Section 1. That the findings set out in the preamble to this resolution are hereby in all things <br />approved. <br />Section 2. That the City Council of the City of Paris hereby finds and determines, based <br />upon the testimony and information provided by Lamar County Water Supply District, City staff and <br />citizens speaking at the public hearing that there is no reasonable or prudent alternative for locating <br />the proposed 16"water line other than under a portion of Lake Crook as further described in Exhibits <br />A and B and depicted in Exhibit C attached hereto and that the Project has been planned and <br />designed so as to minimize any harm to this portion of Lake Crook. <br />Section 3. That the request from Lamar County Water Supply District fora 20 foot utility <br />easement and a 50 foot temporary construction easement crossing under a part of Lake Crook <br />property as described in Exhibits A, B and C attached hereto, be and is hereby approved. <br />Section 4. That the Mayor of the City of Paris be, and he is hereby authorized and directed <br />to execute the 20 foot water line easement and the 50 foot temporary construction easement from <br />the City of Paris to Lamar County Water Supply District, substantially according to the documents <br />attached hereto as Exhibits A, B and C. <br />Section 5. That this resolution shall be effective from and after the date of passage. <br />
