<br />Regular City Council Meeting <br />December 10, 2007 <br />Page 6 <br /> <br />Mayor Freelen opened the public hearing and asked for anyone speaking in favor of <br />this item to do so. Clarene Green Montgomery, sister of Al Green, announced that he wished to <br />withdraw his application for rezoning the property. Mayor Freelen asked for anyone speaking <br />against this item to do so. With no one else speaking, Mayor Free1en closed the public <br />hearing. <br /> <br />A Motion to accept the withdrawal was made by Council Member Fisher and seconded by <br />Council Member Strathern. Motion carried, 7 ayes - 0 nays. <br /> <br />F. Consideration of and action on the Preliminary Plat of Lot 1, Block A, Omega 306 <br />Addition, and discussion and possible action on variance request for deferring curb <br />and gutter construction, being number 2885 Stillhouse Road. <br /> <br />Subject to the City Engineer's recommendations, a Motion to approve this item was made by <br />Council Member Biard and seconded by Council Member Brown. <br /> <br />Council Member Wilson said he had a problem with the recommendation of eliminating curb <br />and gutter. He went on to say there would be a problem with future development in the area and if <br />the developer did not want to put in curb and gutter, the developer should deposit funds with the City <br />of Paris for his part offuture development ofthe area. He further stated it would not be fair to others <br />purchasing property in the area to have to pay the full costs of curb and gutter. Shawn Napier said <br />if they did grant a variance, there were several options to consider and one was the developer placing <br />funds with the City, so that the City could build in curb and gutter in the future. Council Member <br />Biard withdrew his Motion. <br /> <br />Subject to the City Engineer's recommendations, a Motion to approve the preliminary plat and <br />to take no action on the variance was made by Council Member Biard and seconded by Council <br />Member Strathern. Motion carried, 7 ayes - 0 nays. A Motion to deny the variance on curb and <br />gutter was made by Council Member Wilson and seconded by Council Member Brown. A vote was <br />not taken. <br /> <br />Shawn Napier informed Council the owner was present. Mayor Freelen asked him to come <br />forward. Developer John Griffin, 1201 Saddlebrook Drive, McKinney, Texas, said it was impractable <br />to put in curb and gutters at this time. He went on to say one of the options discussed was to put up <br />money in reserve should the street be widened in the future. He said they were not opposed to <br />looking at options. Council Member Wilson withdrew his Motion. Council Member Wilson asked <br />Shawn Napier if this would come back to Council with his recommendations. Shawn explained if <br />Council approves this, the developer would have to come to City staffwith a site plan showing how <br />they are going to do all of this. City staff would then work through the process to determine approval. <br />Once that work is completed and City staff accepts same, it would come back to City Council in form <br />of a final plat. <br />
