Regular City Council Meeting December 10, 2007 Page 6 Mayor Freelen opened the public hearing and asked for anyone speaking in favor of this item to do so. Clarene Green Montgomery, sister of Al Green, announced that he wished to withdraw his application for rezoning the property. Mayor Freelen asked for anyone speaking against this item to do so. With no one else speaking, Mayor Free1en closed the public hearing. A Motion to accept the withdrawal was made by Council Member Fisher and seconded by Council Member Strathern. Motion carried, 7 ayes - 0 nays. F. Consideration of and action on the Preliminary Plat of Lot 1, Block A, Omega 306 Addition, and discussion and possible action on variance request for deferring curb and gutter construction, being number 2885 Stillhouse Road. Subject to the City Engineer's recommendations, a Motion to approve this item was made by Council Member Biard and seconded by Council Member Brown. Council Member Wilson said he had a problem with the recommendation of eliminating curb and gutter. He went on to say there would be a problem with future development in the area and if the developer did not want to put in curb and gutter, the developer should deposit funds with the City of Paris for his part offuture development ofthe area. He further stated it would not be fair to others purchasing property in the area to have to pay the full costs of curb and gutter. Shawn Napier said if they did grant a variance, there were several options to consider and one was the developer placing funds with the City, so that the City could build in curb and gutter in the future. Council Member Biard withdrew his Motion. Subject to the City Engineer's recommendations, a Motion to approve the preliminary plat and to take no action on the variance was made by Council Member Biard and seconded by Council Member Strathern. Motion carried, 7 ayes - 0 nays. A Motion to deny the variance on curb and gutter was made by Council Member Wilson and seconded by Council Member Brown. A vote was not taken. Shawn Napier informed Council the owner was present. Mayor Freelen asked him to come forward. Developer John Griffin, 1201 Saddlebrook Drive, McKinney, Texas, said it was impractable to put in curb and gutters at this time. He went on to say one of the options discussed was to put up money in reserve should the street be widened in the future. He said they were not opposed to looking at options. Council Member Wilson withdrew his Motion. Council Member Wilson asked Shawn Napier if this would come back to Council with his recommendations. Shawn explained if Council approves this, the developer would have to come to City staffwith a site plan showing how they are going to do all of this. City staff would then work through the process to determine approval. Once that work is completed and City staff accepts same, it would come back to City Council in form of a final plat.
