Regular City Council Meeting <br />April 14, 2008 <br />Page 6 <br />CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE <br />SUBJECT; AND DECLARING AN EFFECTIVE DATE. <br />Mayor Freelen explained that the Council wanted to insure that the citizens were allowed to <br />vote prior to any decision being made regarding this issue. A Motion to approve and adopt the <br />ordinance as submitted, was made by Council Member Biard and seconded by Council Member <br />Strathern. Council Member Strathern asked that the ordinance be read again. Kent McIlyar stated <br />that at the last meeting in March, Council directed staff to bring back an ordinance that would require <br />a vote of the qualified voters of the citizens of the City of Paris before any additional water is sold <br />from Lake Pat Mayse outside Lamar County. Mr. McIlyar proceeded to read the caption of the <br />ordinance as set out above. Mr. McIlyar read aloud sections one through five, as requested by <br />Council Member Wilson. Kent McIlyar asked if there were any questions and there were none. <br />Motion carried, 6 ayes - 0 nays. <br />20. Receive, deliberate and act on a report of the City Clerk regarding Certification of an Initiative <br />Petition proposing an ordinance prohibiting the authorization of the power to negotiate for the <br />sale of raw water from Lake Pat Mayse and/or Lake Crook to be transported beyond the <br />boundaries of Lamar County, Texas, filed March 18, 2008. <br />Mayor Freelen stated this petition was initially to be certified at this meeting. He asked City <br />Clerk Janice Ellis to proceed with item 20. Ms. Ellis stated that due to the conflict between the <br />Affidavits presented earlier in the evening and the Affidavit that was presented by a circulator of the <br />petition, there was a question as to the validity of the signatures on the initiative petition and whether <br />or not they were properly secured. Ms. Ellis said that she could not present the report nor the <br />certificate of sufficiency based on the information received. Mayor Freelen announced there was no <br />action to be taken on this item. <br />21. Receive, deliberate and act on a report of the City Clerk regarding Certification of an Initiative <br />Petition proposing an ordinance adopting a new section to the existing Code of Ordinances <br />of the City of Paris, Texas, relating to establishment of a limit on taxes for qualifying <br />individuals pursuant to article 8, section 1-b(h) of the Texas Constitution and Texas Tax Code <br />Section 11.261. <br />Based on review of the petition, Janice Ellis issued a certificate of sufficiency. <br />22. Deliberate and act on a preliminary plat of Lot 2, City Block 212, West Austin 212 Addition. <br />A Motion to approve the preliminary plat was made by Council Member Wilson and seconded <br />by Council Member Gray. Motion carried, 6 ayes - 0 nays. <br />23. Deliberate and act on a preliminary and final plat for Food Fast Corporation of Lot 1, Block <br />A, City Block 170-A, being number 2107 S.
