DRAFT <br />Attorney\ordword\current\Exemption for elderly-Amend Section 30-16 - 2008 <br />ORDINANCE NO. <br />AN ORDINAIVCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />AMEIVDING SECTION 30-16, AND 30-31, CHAPTER 30, ARTICLE II OF <br />THE CITY OF PARIS CODE OF ORDINANCES; PROVIDING FOR A <br />DECREASE I1V THE AMOUNT OF RESIDENCE HOMESTEAD EXEMPTIOIV <br />FOR PERSONS SIXTY-FIVE (65) YEARS OF AGE OR OLDER AND FOR <br />DISABLED PERSOIVS QUALIFYING FOR A DISABILITY HOMESTEAD; <br />REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT <br />HEREWITH; MAKING OTHER FINDINGS AND PROVISIOIVS RELATED TO <br />THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. <br />WHEREAS, on September 25, 2006 the City Council of the City of Paris enacted <br />Ordinance No. 2006-037 approving an increase in the amount of residence homestead <br />exemption for persons sixty-five (65) years of age or older from $17,000.00 to $20,000.00; <br />and, <br />WHEREAS, on September 25, 2006 the City Council of the City of Paris enacted <br />Ordinance No. 2006-038 approving a homestead exemption for disabled persons qualifying <br />for disability homestead in the amount of $20,000.00; and, <br />WHEREAS, the tax exemption increase for persons sixty-five (65) years of age or <br />older was raised by the City Council as an alternative to implementing a tax freeze on ad <br />valorem taxes for persons 65 years of age or older and for disabled persons; and, <br />WHEREAS, on March 18, 2008, an initiative petition was filed by a group of <br />registered voters proposing a new ordinance establishing a limit on taxes for residence <br />homesteads of disabled persons and persons age 65 or older; and, <br />WHEREAS, the City of Paris relies upon the collection of ad valorem taxes as a <br />primary source of revenue for providing City services that citizens of Paris rely upon every <br />day, and the City budget would be adversely affected over time if the $20,000 tax <br />exemption and the tax freeze were both put in place; and, <br />WHEREAS, the City Council hereby finds and determines that it is in the best <br />interest of the City of Paris and its citizens if the $20,000 tax exemption for persons age 65 <br />or older and disabled persons is reduced back to $ <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, TEXAS: <br />Section 1. That the findings set out in the preamble to this ordinance are hereby <br />in all things approved. <br />51 (ct) <br />
