City agrees that all notices or communications to Consultant permitted or <br />required under this Agreement shall be addressed to Consultant at the following <br />address: <br />J. Stowe & Co. <br />1560 J. Place, Suite 379 <br />Plano, TX 75074 <br />All notices or communications required to be given in writing by either party shall <br />be considered as having been given if addressed in writing as set out above and <br />delivered in person or three (3) days after mailing by first-class registered or certified <br />mail, return receipt requested, postage prepaid. <br />XVI. Miscellaneous <br />A. Paragraph Headings: <br />The paragraph headings contained herein are for convenience only and are not <br />intended to define or limit the scope of any provision in this Agreement. <br />B. Contract Interpretation: <br />Although this Agreement is drafted by the City, should any part be in dispute, the <br />parties agree that the Agreement shall not be construed more favorably for either party. <br />C. Non-Waiver: <br />No waiver of either party's rights under this Agreement shall be deemed to have <br />been made unless expressed in writing and signed by an authorized representative of <br />that Party. <br />D. Venue/Governing Law: <br />The parties agree that the laws of the State of Texas shall govern this <br />Agreement, and that the Agreement is performable in Lamar County, Texas. Exclusive <br />venue shall lie in Lamar County, Texas. <br />E.
