It has been suggested that if we do not use our water rights i.n Pat Mayse that <br />these could be revoked by the TCEQ. Historically, has this ever happened in <br />Texas? What are some of the reasons why it would or would not be likely in the <br />foreseeable future? <br />2. In the PMLSC briefing book, there are two references to the possibility of the <br />State reallocating some of the unused water in Pat Mayse Lake, the rights to <br />which The City of Paris currently has or is in the process of acquiring. <br />0 What is the statutory or case law that allows this? <br />4 Are there any precedents for this action being taken? <br />41 What are they? <br />4 Are the circumstances similar to the situation Paris is currently in? <br />• What factors cause an impoundment to fall under Congressional control? Size? <br />Proposed uses? Drainage basin location? <br />3. What does it mean to "perfect" water rights? Why would we "never" sell water <br />rights? <br />Red River Compact <br />4. Is the Red River Compact, or any other interstate compact, relevant to this <br />committee's charge? Does Paris have control of the discharge from its wastewater <br />treatment plant, or water downstream of the Pat Mayse and Lake Crook spillways, <br />or return flows from Lamar Power and Campbell Soup? <br />5. What effects does the Red River Compact have on our situation (what scenarios <br />can we eliminate up front from the long list of possibilities we have to consider; <br />e.g. is the City prevented from taking action to impound more water, reducing the <br />amount that flows downstream)? <br />Permitting of Intei--basin Transfer <br />6. What are some of the typical issues that Irving might need to address in a trans- <br />basin permit? <br />7.
