Regular City Council Meeting <br />July 14, 2008 <br />Page 4 <br />CONDUCTED IN THE CITY HALL ANNEX WEST, FROM THE 20"'` DAY OF <br />OCTOBER, 2008, THROUGH THE 31 S" DAY OF OCTOBER, 2008, ON THE QUESTION <br />OF ESTABLISHING A LIMIT ON THE TOTAL AMOUNT OF TAXES THAT MAY BE <br />IMPOSED ON THE RESIDENCE HOMESTEAD OF A DISABLED PERSON OR <br />PERSON SIXTY-FNE (65) YEARS OF AGE OR OLDER PURSUANT TO ARTICLE 8, <br />SECTION 1-b(h) OF THE TEXAS CONSTITUTION AND TEXAS TAX CODE SECTION <br />11.261; PRESCRIBING THE FORM OF THE BALLOT; PERMITTING ONLY RESIDENT <br />QUALIFIED VOTERS TO VOTE; PROVIDING FOR AN EARLY VOTING BALLOT <br />BOARD; PROVIDING FOR NOTICE OF THE ELECTION; MAKING OTHER FINDINGS <br />AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTNE <br />DATE. <br />Kent McIlyar said at the last meeting Council had instructed him to bring back a resolution <br />calling a special election, as well as an ordinance that would create the tax exemption without a <br />special election and those were items 11 and 12. Council Member Biard inquired if Council passed <br />the ordinance would it be for the 2008 tax year. Mr. McIlyar said yes and that it would be based on <br />the total tax dollar paid. Council Member Brown said to have a special election would cost the City <br />between $10,000.00 and $15,000.00. Mayor Freelen expressed concern for someone who was 65 <br />years old or disabled, in that the individual doesn't have an option to make more money. He said this <br />exemption would be good for the community. Council Member Strathern said citizens should have <br />the right to vote. Council Member Pickle said they owed it to the citizens to allow them to vote on <br />this issue. <br />A Motion to call a special election was made by Council Member Pickle and seconded by <br />Council Member Strathern. Motion carried, 6 ayes -1 nay, with Council Member Freelen casting the <br />dissenting vote. <br />12. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />AMENDING ARTICLE II, CHAPTER 30 TAXATION OF THE CODE OF ORDINANCES <br />OF THE CITY OF PARIS, TEXAS BY ADDING A NEW DNISION 3. TAX LIMIT FOR <br />QUALIFIED PERSONS SECTION 30-32, ENTITLED TAX LIMIT FOR PERSONS AGE <br />65 AND OLDER OR DISABLED; ESTABLISHING A LIMIT ON TAXES FOR <br />QUALIFYING INDIVIDUALS PURSUANT TO ARTICLE 8, SECTION 1-b(h) OF THE <br />TEXAS CONSTITUTION AND TEXAS TAX CODE SECTION 11.261; MAKING OTHER <br />FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A <br />REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE AND <br />PROVIDING AN EFFECTNE DATE. <br />No action was necessary on this item, because action on item 11 made this item moot. <br />13. RESOLUTION NO. 2008-052: A RESOLUTION OF THE CITY COLJNCIL OF THE CITY <br />OF PARIS, TEXAS, AWARDING THE CONTRACT FOR THE DEMOLITION AND <br />M' 000007 <br />
