Sec. 10-100. Purpose of section. <br />The purpose of this article is to require off-street parking and loading <br />facilities in proportion to the parking demand for each use in order to ensure <br />functionally adequate, aesthetically pleasing, and secure off-street parking <br />and loading facilities. The regulations and design standards of this section <br />are intended to accomplish the following: <br />(1) To ensure the usefulness of parking and loading facilities; <br />(2) To ensure sufficient parking spaces on-site in order to prevent <br />inappropriate parking on public streets and in residential <br />neighborhoods; <br />(3) To ensure that developments are not designed with excessive <br />parking; and <br />(4) To ensure that access to parking and loading facilities does not <br />impair the function of adjacent roadways or endanger the public <br />safety. <br />Sec.10-101. Applicability of section provisions. <br />(a) Building permit required. No new parking lot may be constructed or <br />existing parking resurfaced without first obtaining a building permit. <br />(b) Submission of plans. Applications for building permits and certificates <br />of occupancy shall include parking site plans showing the design of off-street <br />parking areas, including the layout of spaces, aisles, fire apparatus access <br />roads, and the location of ingress and egress points. Submission of a <br />parking plan may be waived only when it is not necessary to determine <br />compliance with requirements. <br />(c) New and conforming development. New development occurring after <br />August 18, 2008, and development existing on August 18, 2008 which <br />complies with the requirements of this section, shall be subject to the <br />following provisions: <br />(1) Every use of a building or land hereafter established shall <br />provide the minimum off-street parking and loading spaces as <br />required by this section. The adequate provision of parking <br />spaces will be reviewed during rezoning, specific use permit <br />(SUP), site plan, and certificate of occupancy approvals. <br />Page 2 of 17 <br />w UIJU22J <br />
