RESOLUTION NO. 2008-076 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />DECLARING THE WOODEN GAZEBO STRUCTURE ON CULBERTSON PARK <br />PROPERTY AT THE FORMER MINIATURE GOLF SITE TO BE <br />DILAPIDATED AND SURPLUS PROPERTY AND AUTHORIZING THE SALE <br />OF THIS STRUCTURE TO jERRY KYLE, THE PERSON WHO BUILT THE <br />STRUCTURE FOR THE VALUE OF THE COST TO DISMANTEL AND <br />REMOVE FROM CITY PROPERTY; MAKING OTHER FINDINGS AND <br />PROVISIONS RELATED TO THE SUBjECT; AND PROVIDING A111 <br />EFFECTIVE DATE. <br />WHEREAS, during the early 90's City of Paris leased a portion of Culbertson Park to <br />Jerry Kyle which was used as a Miniature Golf Course. Mr. Kyle, during the time he was <br />leasing the miniature golf course, built a wooden gazebo with benches and a table for <br />people to use while playing miniature golf. The miniature golf course closed many years <br />ago; and, <br />WHEREAS, over time the gazebo structure has deteriorated and the benches and <br />table were removed for safety reasons and the estimated annual cost for repair and upkeep <br />is between $800 to $1,400; and, <br />WHEREAS, there is no known or anticipated municipal use for the deteriorating <br />structure and for safety reasons should be removed from City property; and, <br />WHEREAS, Jerry Kyle has requested the City to allow him to remove the wood <br />gazebo structure to be rebuilt on their home property; and, <br />WHEREAS, it is deemed appropriate that this structure be declared dilapidated and <br />surplus property and Mr. Kyle be allowed to remove this structure from the park property <br />for the value of the cost of dismantling the structure and removing the structure in its <br />entirety from the City property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, TEXAS: <br />Section 1. That the findings set out in the preamble to this resolution are hereby in <br />all things approved. <br />Section 2. That the wooden gazebo located on Culbertson Park property be <br />declared surplus property and sold to Jerry Kyle for the value of the cost to dismantle and <br />remove the structure in its entirety from the City of Paris park property. <br />Section 3. That this resolution shall be effective from and after its date of passage. <br />
