Second Reading - ORDINANCE NO. 2008-035: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, DISANNEXING 675.13 ACRES OF LAND FORMING A PORTION OF THE CURRENT SOUTHEASTERN OUTER BOUNDARY OF THE CITY LIMITS OF THE CITY OF PARIS, GENERALLY LOCATED ON STATE HIGHWAY 271 SOUTH, BEGINNING THREE-QUARTERS (3/4) MILE SOUTHEAST OF LOOP 286 SE ALONG THE NORTH RIGHT-OF-WAY L1NE OF HWY 271 SOUTH TO A POINT SOUTHEAST OF THE MEADOWBROOK CEMETERY, IN RESPONSE TO A PETITION FOR SUCH DISANNEXATION FILED BY 17 QUALIFIED VOTERS AND PROPERTY OWNERS FROM THE AREA REQUESTING DISANNEXATION; MAKING A FINDING WITH REGARD TO THE VALUE OF CITY SERVICE PROVIDED TO THE AREA COMPARED TO PROPERTY TAXES PAID BY THE AFORESAID DISANNEXED LANDOWNERS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE. Council Member Strathern asked to be recused from voting on this item, because he owns property in the proposed area for disannexation. A Motion to recuse Council Member Strathern was made by Council Member Biard and seconded by Council Member Brown. Motion carried, 6 ayes - 0 nays. Council Member Strathern left the room. A Motion to approve the disannexation was made by Council Member Brown and seconded by Council Member Kear. Motion carried, 6 ayes - 0 nays. A Motion to return Council Member Strathern to the meeting was made by Council Member McCarthy and seconded by Council Member Brown. Motion carried, 6 ayes - 0 nays. Council Member Strathern returned to the room. Mayor Freelen explained that Bill Strathern was stepping down from his seat on the Council, because his property was disannexed making him disqualified to continue to serve on the Council. Mayor Freelen presented Council Member Strathern with a plaque for his service to the City of Paris. 6. Public Hearing and deliberate and act on a resolution supporting the safe routes to Schools Master Plan. Mayor Freelen opened the public hearing and asked anyone that wished to speak, to please come forward. With no one speaking, Mayor Freelen closed the public hearing.
