Second Reading - ORDINANCE NO. 2008-035: AN ORDINANCE OF THE CITY <br />COUNCIL OF THE CITY OF PARIS, TEXAS, DISANNEXING 675.13 ACRES OF LAND <br />FORMING A PORTION OF THE CURRENT SOUTHEASTERN OUTER BOUNDARY <br />OF THE CITY LIMITS OF THE CITY OF PARIS, GENERALLY LOCATED ON STATE <br />HIGHWAY 271 SOUTH, BEGINNING THREE-QUARTERS (3/4) MILE SOUTHEAST <br />OF LOOP 286 SE ALONG THE NORTH RIGHT-OF-WAY L1NE OF HWY 271 SOUTH <br />TO A POINT SOUTHEAST OF THE MEADOWBROOK CEMETERY, IN RESPONSE TO <br />A PETITION FOR SUCH DISANNEXATION FILED BY 17 QUALIFIED VOTERS AND <br />PROPERTY OWNERS FROM THE AREA REQUESTING DISANNEXATION; MAKING <br />A FINDING WITH REGARD TO THE VALUE OF CITY SERVICE PROVIDED TO THE <br />AREA COMPARED TO PROPERTY TAXES PAID BY THE AFORESAID <br />DISANNEXED LANDOWNERS; MAKING OTHER FINDINGS AND PROVISIONS <br />RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY <br />CLAUSE, A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE. <br />Council Member Strathern asked to be recused from voting on this item, because he owns <br />property in the proposed area for disannexation. A Motion to recuse Council Member Strathern was <br />made by Council Member Biard and seconded by Council Member Brown. Motion carried, 6 ayes - <br />0 nays. Council Member Strathern left the room. <br />A Motion to approve the disannexation was made by Council Member Brown and seconded <br />by Council Member Kear. Motion carried, 6 ayes - 0 nays. A Motion to return Council Member <br />Strathern to the meeting was made by Council Member McCarthy and seconded by Council Member <br />Brown. Motion carried, 6 ayes - 0 nays. Council Member Strathern returned to the room. <br />Mayor Freelen explained that Bill Strathern was stepping down from his seat on the Council, <br />because his property was disannexed making him disqualified to continue to serve on the Council. <br />Mayor Freelen presented Council Member Strathern with a plaque for his service to the City of Paris. <br />6. Public Hearing and deliberate and act on a resolution supporting the safe routes to Schools <br />Master Plan. <br />Mayor Freelen opened the public hearing and asked anyone that wished to speak, to please <br />come forward.
