<br />ORDINANCE NO. 2003-040 <br /> <br />AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING <br />THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY <br />REVISING SECTION 18-23(a)(3) OF SAID CODE; PROVIDING THAT <br />FINES AND SPECIAL EXPENSES ARE IN COMPLIANCE WITH STATE <br />LAW; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN <br />CONFLICT HEREWITH; AND DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council of the City of Paris. Paris, Texas, did heretofore, on the <br />12th day ofJuly, 1999, in Ordinance No. 99-052, amend Section 18-23 ofthe Code of Ordinances <br />of the City of Paris to establish a municipal court technology fund and to ensure that fines and <br />special expenses were in compliance with State law; and <br /> <br />WHEREAS, the Texas Legislature did heretofore, during the 78th Regular Legislative <br />Session, adopt H. B. 1066, effective September 1, 2003, which repealed the sunset provision which <br />required the fund to expire September 1, 2005, and added as a valid use of the fund the <br />maintenance of technological enhancements; NOW, THEREFORE, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, <br />TEXAS: <br /> <br />Section 1. That Section 18-23(a)(3) of the Code of Ordinances ofthe City of Paris, Paris, <br />Texas, be, and the same is hereby, amended so that such shall read as follows: <br /> <br />"Sec. 18-23. Fines and special expenses. <br /> <br />(a) The municipal court is authorized and empowered to enforce by execution on <br />the property of the defendant, or imprisonment of the defendant, the collection of <br />all fines imposed by the court, not inconsistent with the laws of the state. The <br />following special expenses and fees are hereby established as follows: <br /> <br />(3) A technology fee, upon conviction of a misdemeanor offense in <br />municipal court of offenses committed on or after the effective date of this <br />ordinance in the amount of four dollars ($4.00) for the municipal court <br />technology fund. In accordance with Article 102.0172, Code of Criminal <br />Procedure, the fund may be used only to finance the purchase of or to <br />maintain technological enhancements for the municipal court, including: <br /> <br />A. Computer systems; <br />B. Computer networks; <br />C. Computer hardware; <br />
