estimated total energy requirement of all Participating Members during the Base <br />Year. <br />"Member's Delivery Points" shall be all ESI-IDs accounts that Member has for <br />receipt of energy to the revenue meters of such Member that are metered and the <br />light fixtures for street/outdoor lights or other accounts of such Member that are <br />not metered. <br />"Member's Unique Delivery Costs" shall have the meaning set forth in Section <br />6.1(b) hereof. <br />"Monthly Capacity PaymenY" shall have the meaning set forth in Article 7 below. <br />"Monthly Energy Payment" means the product of the Monthly Energy Price <br />times Member's Energy Allocation Percentage times the megawatt hours <br />delivered to CAPP by the Facility Owners during the Delivery Month. <br />"Monthly Energy Price" means the price per megawatt hour as set forth in the <br />PPA. <br />"MW ' means megawatt. <br />"MWh" means megawatt hour. <br />"New Governmental Charges" means (i) any Governmental Charges enacted and <br />effective after the Effective Date, including without limitation, that portion of any <br />Governmental Charges or New Governmental Charges that constitutes an increase <br />or that cause the Facility or Facilities to incur additional or new expenses less <br />Governmental Charges enacted or imposed prior to the Effective Date that are <br />replaced by the New Governmental Charge and that become payable by CAPP <br />under the PPA, (ii) any Law or interpretation thereof, enacted and effective after <br />the Effective Date resulting in a new or additional expense to the Facility or the <br />Facilities or the application of any Governmental Charges to a new or different <br />class of parties and that become payable by CAPP under the PPA. <br />"Oak Grove Faciliry" means, when the first commercial operation date is <br />reached, Oak Grove Unit 1 and Oak Grove Unit 2 of the lignite coal- fired power <br />generation facility known as the Oak Grove Generating Station located in <br />Robertson County, Texas. <br />"Ordered Backdown" has the meaning set forth in Section 5.2 of the PPA. <br />"Participant Contracts" means those individual contracts between CAPP and a <br />Participating Member under which such Participating Member is acquiring a <br />portion of the Contract Energy that CAPP is acquiring for the benefit of all <br />9 <br />`Y <br />a~ 0 0 vli3 <br />
