<br />Section 2. That the City Council finds and determines that the aforesaid severe winter <br />conditions and ice storms constitute a public calamity requiring the immediate appropriation of <br />money in support of procurements to relieve the necessity of the municipality's residents or to <br />preserve the property of the municipality. <br /> <br />Section 3. That the City Council find and determines that the aforesaid severe winter <br />conditions and ice storms justify procurements necessary to preserve or protect the public health or <br />safety of the municipality's residents. <br /> <br />Section 4. That the City Council finds and determines that because of the extreme winter <br />conditions and ice storms procurements are necessary because of unforseen damage to public <br />machinery, equipment, or other properties. <br /> <br />Section 5. That the aforesaid severe winter conditions and ice storms constitute an <br />emergency and urgent public necessity justifying utilization of emergency procurement procedures <br />designed to allow the City to contract as soon as possible, but in full compliance with State and <br />Federal regulations related to emergency procurements in support of disasterrelief, and still allowing 0 <br />for informal competition among contractors and bidders. <br /> <br />Section 6. That the City Manager be, and he is hereby, authorized to undertake any and all <br />measures reasonably necessary to utilize force account and City staff resources, or to contract with <br />qualified contractors for debris removal and other emergency actions necessitated by the severe <br />winter conditions and ice storms, subject to the terms and provisions of this resolution requiring <br />compliance with all applicable State and Federal regulations regarding emergency procurement <br />during disaster conditions, and furtherto pursue informal competition among bidders and contractors <br />for such services. <br /> <br />Section 7.
