2001-063-RES ACCEPTING DONATION OF ONE PORTABLE BUILDING FROM PISD FOR USE BY PARIS POLICE DEPT

INTERLOCAL AGREEMENT STATE OF TEXAS ~ ~ ~ KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LAMAR WHEREAS, Chapter 791 of the Local Government Code authorizes local governments, including municipalities and independent school districts, to enter into interlocal agreements to perform governmental functions and services; and, WHEREAS, the purpose of Chapter 791 and the contracts authorized therein is to increase the efficiency and effectiveness of local governments by authorizing them to enter into said contracts; and, WHEREAS, the City of Paris and the Paris Independent School District desire to enter into an interlocal agreement whereby the Paris Independent School District will donate to the City of Paris one surplus portable building with the understanding that such building shall be located at the City's Police Station complex and shall be utilized for Police Department purposes to the benefit of the Paris Independent School District and to the citizens of the City of Paris; and, WHEREAS, the City of Paris desires to gratefully accept said donation and to utilize said surplus portable building as agreed to by the parties; WHEREFORE, premises considered, the CITY OF PARIS, PARIS, TEXAS, a municipal corporation, acting by and through its Mayor, duly authorized, hereinafter called CITY, and the PARIS INDEPENDENT SCHOOL DISTRICT BOARD OF EDUCATION, acting by and through its President, duly authorized, hereinafter called PISD, do hereby contract and agree as follows: 1. PISD agrees to donate and CITY agrees to accept one (I) portable building which is currently located on a PISD campus. 2. CITY agrees to move the one (1) portable building to 811 Bonham Street to be used for expanding the Police Department facilities. 3. CITY agrees to repair fences and generally restore the school's property to a similar condition as existed prior to the moving of the building. EXHIBIT A
