<br />AUCTIONEER SERVICE AGREEMENT <br /> <br />This agreement is entered into by MONTE MOORE AUCTIONEERS, hereinafter referred <br />to as Seller, of Paris, Texas, and the CITY OF PARIS, PARIS, TEXAS, hereinafter referred to as <br />Owner, under the following terms and conditions: <br /> <br />1. Seller agrees to conduct a public auction sale or to otherwise sell the property described in <br />Exhibit A, attached hereto, belonging to Owner, trustees, creditors, or secured parties. The auction <br />sale to be conducted at the old Foxworth-Galbraith building located at 2195 Loop 286 N.E., Paris, <br />Texas, beginning on the 1st day of June, 2002. <br /> <br />2. Owner will furnish Inventory with serial numbers to be attached to this contract. <br /> <br />3. Seller agrees to prepare all advertising material and publicity necessary to properly advertise <br />and promote the attendance of buyers at no cost to Owner. <br /> <br />Owner agrees to pay Seller for the services rendered by Seller a commission of nine percent <br />(9%) ofthe total income from all sales made during the period of this contract whether such sales <br />are made at public auction, by private sale or in any other manner. <br /> <br />This contract and agreement shall be binding upon the parties for a period of sixty (60) days <br />after the execution hereof. <br /> <br />Executed this 13th day of May, 2002. <br /> <br />CITY OF PARIS, PARIS, TEXAS <br /> <br />By: <br /> <br />Michael J.
