<br />RESOLUTION NO. 2003-143 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, AUTHORIZING AND ACCEPTING A SETTLEMENT ON <br />SUCH TERMS AND CONDITIONS AS THE LAMAR COUNTY APPRAISAL <br />DISTRICT SHALL DEEM APPROPRIATE IN PENDING LITIGATION <br />WITH CAMPBELL SOUP COMPANY; MAKING OTHER FINDINGS AND <br />PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, there is pending on the docket of the 6th Judicial District Court that cause No. <br />66751, styled Campbell SouP v. Lamar County Appraisal District; and, <br /> <br />WHEREAS, there is pending in the 62nd Judicial District Court that cause No. 71750, <br />styled Campbell Soup and Campbell Soup Supply Company v. Lamar County Appraisal District; <br />and, <br /> <br />WHEREAS, the aforesaid suits are tax suits involving ad valorem taxes collected on behalf <br />ofthe North Lamar Independent School District, the City of Paris, Lamar County, and Paris Junior <br />College; and, <br /> <br />WHEREAS, it would be in the best interests of the Lamar County Appraisal District, the <br />affected taxing entities and Campbell Soup Company to resolve said litigation on terms and <br />conditions acceptable to all parties; NOW, THEREFORE, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, <br />TEXAS: <br /> <br />Section 1. That the findings set out in the preamble to this resolution are hereby in aU <br />things approved. <br /> <br />Section 2. That the City Council does hereby authorize and accept a settlement on such <br />terms and conditions as the Lamar County Appraisal District shall deem appropriate in that <br />litigation pending in the 6th Judicial District Court, Cause No. 66751, styled Campbell Soup v. <br />Lamar County Appraisal District, and that further litigation pending in the 62nd Judicial District <br />Court, Cause No. 71750, styled Campbell Soup and Campbell Soup Supply Company v. Lamar <br />County Appraisal District. <br /> <br />Section 3. That, to the extent any substantive approvals or agreements are required to <br />implement the aforesaid settlements, the :Mayor shall be and is hereby authorized to execute and <br />the City Clerk to attest to the aforesaid agreements. <br /> <br />Section 4. That this resolution shall be effective from and after its date of passage. <br />
