RESOLUTION NO. 2003-122 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AUTHORIZING THE SALE OF A 7.104 ACRE TRACT OF LAKE CROOK PROPERTY OUT OF THE T. G. CmSUM SURVEY, PREVIOUSLY DECLARED TO BE SURPLUS PROPERTY; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris did heretofore on the 14th day of October, 1991, in Resolution No. 91-108, declare a 7.104 acre tract located on the southeast boundary of Lake Crook property as described on the survey attached hereto as Exhibit A, to be of no known municipal use and declared to be surplus property in order that the property line may be improved; and, WHEREAS, at the time said property was declared to be surplus, J. T. Stephens had requested to purchase the property for the market value, and the transaction was never completed; and, WHEREAS, the City has been contacted by a Mr. David R. Robinson who has purchased Mr. J. T. Stephens' property and is desirous of purchasing the said surplus 7.104 acre tract; and, WHEREAS, there continues to be no known municipal use for the same and because of the location of the property it is basically land locked it would be right and proper to approve the sale of this property to the adjacent property owner; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the 7.104 acre tract located on the southeast boundary of said Lake Crook property as described on the survey attached hereto as Exhibit A, be, and the same remains to be declared surplus property. Section 3. That the minimum fair market value of said property, based on the value of adjacent property as established by the Lamar County Appraisal District, shall be and is $750.00 per acre or portion thereof. Section 4. That the 7.104 acre tract may be disposed of in accordance with the laws of the State of Texas and the Charter of the City of Paris, and the City Manager and the City Attorney are hereby authorized to undertake any and all actions in accordance with state law and the City Charter to dispose of said property, including executing deeds and other instruments associated therewith.
