RESOLUTION NO. 2003-077 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, RATIFYING THE TERMINATION FOR CAUSE OF THE CITY'S GROUNDS MAINTENANCE AGREEMENT WITH JACK RAY BARTON, CONTRACTOR; APPROVING THE ADVERTISEMENT FOR BIDS FOR FURNISHING LABOR, MATERIALS, AND EQUIPMENT AND FOR PERFORMING ALL WORK REQUIRED FOR GROUNDS MAINTENANCE ON SPECIFIED CITY OF PARIS PARKS AND FACILITIES; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris did heretofore, in Resolution No.2002- 153, on September 17,2002, award the bid and approve execution of an Agreement for Grounds Maintenance with Jack Ray Barton; and, WHEREAS, the City Director of Public Works did heretofore by letter dated April 17 , 2003, notify Jack Ray Barton that the City of Paris was terminating said Agreement for Grounds Maintenance with Jack Ray Barton for failure to perform the services required under the terms and conditions of the Agreement effective thirty (30) days from the date of notice in conformance with said Agreement; and, WHEREAS, the City Council desires to ratify said notice of termination and authorize the re-advertisement for bids for said Grounds Maintenance Agreement; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the termination of the City's current Grounds Maintenance Agreement with Jack Ray Barton be, and the same is hereby, ratified. Section 3. That such Agreement for Grounds Maintenance be advertised for bids to be received after due notice at the office of the City Manager of the City of Paris, City Hall, 135 1st Street S.B., Paris, Texas 75460, until 3:00 o'clock p.m. on Tuesday, the 20th day of May, 2003, or such other date as the City Manager shall determine, at which time said bids will be opened in the City Council Chamber, City Hall, 135 1st Street S.E.~ Paris, Lamar County, Texas, and bids will be read aloud, tabulated, and referred to the City Council for its consideration. Section 4. That this resolution shall be effective from and after its date of passage.
