RESOLUTION NO. 2004-184 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, EST ABLISIDNG A TWENTY-EIGHT (28) DAY, TWO- HUNDRED AND TWELVE (212) HOUR WORK PERIOD FOR COMPUTATION OF OVERTIME FOR DESIGNATED FIREFIGHTER AND EMERGENCY MEDICAL SERVICES PERSONNEL; DESIGNATING THE EFFECTIVE PAY PERIOD FOR SAID CHANGE; PROVIDING A REPEALER; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE FOR SAID RESOLUTION. WHEREAS, the City Council of the City of Paris, Paris, Texas, has reviewed the options available to said Council pursuant to state and federal law for the payment of overtime to certain designated firefighter and emergency medical services personnel; and, WHEREAS, the City Council desires to designate a work period for said personnel for purposes of computation of overtime in accordance with the Fair Labor Standards Act of 1938, 29 V.S.C. ~ 201 et seq., and especially 29 V.S.C. ~ 207 (k), and Section 142.0015 ofthe Texas Local Government Code; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That in accordance with the provisions of the Fair Labor Standards Act of 1938,29 V.S.C. ~ 201 et seq., and specifically 29 V.S.C. ~ 207(k), and the provisions of Section 142.0015 of the Texas Local Government Code, and beginning the pay period specified herein, computation of overtime for City of Paris non-exempt, non-civilian, certified firefighters who are engaged in fire suppression (but not fire prevention) activities, and non-exempt, non-civilian, certified emergency medical services personnel who are engaged in emergency ambulance (but not transfer ambulance) activities, shall be on the basis of hours worked in excess of two-hundred and twelve (212) hours in a twenty-eight (28) day work period. Section 3. That payment of overtime in conformance with this resolution shall initiate beginning that pay period dated October 23, 2004, and shall continue thereafter in conformance with this resolution until amended or advised by action of the City Council. Section 4. That all prior resolutions in conflict herewith shall be and are hereby all things repealed.
