RESOLUTION NO. 2004-116 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AUTHORIZING THE EXECUTION OF DEEDS OF ABANDONMENT TO THE ADJACENT PROPERTY OWNERS OF A 120 FOOT WIDE STREET RIGHT-OF-WAY, BEING A PORTION OF 13TH STREET S.W. ABANDONED BY ORDINANCE NO. 2004-018 FROM THE NORTH RIGHT-OF-WAY LINE OF LOOP 286 S.W. GOING NORTH APPROXIMATELY 1,713.1 FEET TO AND INCLUDING A CUL-DE-SAC; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, it has been called to the attention of the City Council of the City of Paris that there is a 120 foot street right-of-way, being a portion of 13th Street S.W., running North and South, BEGINNING at the North right-of-way line of Loop 286 S. W. going North approximately 1,713.1 feet to and including a cul-de-sac; and, WHEREAS, it has been called to the attention of the City Council by petition of the property owners that the street right-of-way is not desired by the property owners adjacent to said street but that said street right-of-way is of use and necessary to the City of Paris and its citizens for drainage and utility easement purposes; and, WHEREAS, the City Council, by prior Ordinance No. 2004-018 adopted July 8,2004, has authorized the City to abandon the City's interest in the aforesaid street right-of-way; and, WHEREAS, it is deemed appropriate that the City's interest in said street right-of-way be conveyed to the adjacent owners on either side of said street right-of-way and that drainage and utility easements be retained; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the Mayor of the City of Paris, be, and he is hereby, authorized and directed to execute, on behalf of the City of Paris, a deed of abandonment conveying to the adjacent owners on either side of said street right-of-way, in accordance with the laws of the State of Texas, the City's interest in the abandoned street right-of-way, being a portion of 13th Street S.W., located in the Southwest Industrial Park, beginning at the North right-of-way line of Loop 286 S.W. going North approximately 1,713.1 feet to and including a cul-de-sac, it appearing that the real and true owners of the hereinafter described lots are as follows:
