RESOLUTION NO. 2004- 098 A RESOLUTION OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING THE EXECUTION OF A TEMPORARY CONSTRUCTION LICENSE AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR DRAINAGE IMPROVEMENTS AT COX FIELD AIRPORT; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the Texas Department of Transportation is proposing drainage improvements under a nationwide 41 permit which includes drainage improvements on FM 1508 on Cox Field Airport property; and, WHEREAS, in order to complete said project it is necessary that temporary construction easements be procured by TxnOT from adjacent property owners; and, WHEREAS, it is deemed in the best interest of the citizens of the City of Paris to grant the necessary temporary construction easement to enable TxDOT to complete said drainage improvements; and, WHEREAS, the form of the Temporary Construction License granting said temporary construction easement attached hereto as Exhibit A, should in all things be approved, and the Mayor should be authorized to execute the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble of this resolution are hereby in all things approved. Section 2. That the request for a temporary construction easement for the proposed drainage improvements under a nationwide 41 permit by the Texas Department of Transportation, which includes drainage improvements on FM 1508 on Cox Field Airport property, is hereby granted. Section 2. That the Mayor of the City of Paris be, and he is hereby authorized and directed to execute, on behalf of the City of Paris, the Temporary Construction License attached hereto as Exhibit A, granting said temporary construction easement to the Texas Department of Transportation. Section 3. That this resolution shall be effective from and after the date of passage. PASSED AND APPROVED this 14th day of June, 2004. ATTEST:
