<br />.j'" <br /> <br />RESOLUTION NO. 2004- 099 <br /> <br />A RESOLUTION OF THE CITY OF PARIS, PARIS, TEXAS, <br />ACCEPfING APPRAISED VALUE ON TWO TEMPORARY <br />CONSTRUCTION EASEMENTS FOR THE TEXAS DEPARTMENT <br />OF TRANSPORTATION-FUNDED PROJECT TO WIDEN LAMAR <br />AVENUE BETWEEN 20TH STREET N.E. AND NORTH COLLEGIATE <br />DRIVE AND ACKNOWLEDGING RECEIPT OF THE REAL ESTATE <br />APPRAISAL REPORTS FROM THE TEXAS DEPARTMENT OF <br />TRANSPORTATION; MAKING OTHER FINDINGS AND <br />PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the Texas Department of Transportation (TxDOT) has undertaken a <br />project to widen Lamar Avenue between 20th Street N.E. and North Collegiate Drive; and, <br /> <br />WHEREAS, the City Council of the City of Paris did heretofore on the 8th day of <br />September, 2003, in Resolution No. 2003-149 acknowledge its wholehearted support of the <br />TxDOT project to widen Lamar A venue between 20th Street N .E. and North Collegiate <br />Drive; and, <br /> <br />WHEREAS, in order to complete said project it is necessary that temporary <br />construction easements be procured by TxDOT from adjacent property owners; and, <br /> <br />WHEREAS, TxDOT has offered the appraised value to the City of Paris for <br />temporary construction easements on two parcels of land owned by the City of Paris, being <br />Parcel 19 TE consisting of a 0.024 acre (1,035 SF) tract of land in easement, situated in <br />Lamar County Texas, part of the George W. Cox Survey, Abstract No. 164 in the amount <br />of $725.00, and Parcel 28 TE consisting of a 0.028 acre (1,199 SF) tract of land in <br />easement, situated in Lamar County Texas, part of the George W. Cox Survey, Abstract No. <br />164 in the amount of $839.00 as described in Exhibits A and B, and should in all things be <br />approved and accepted. <br /> <br />WHEREAS, it is deemed in the best interest of the citizens of the City of Paris to <br />accept the appraised value and grant the necessary temporary construction easements to <br />enable TxDOT to complete said Lamar A venue improvement project; and, <br /> <br />WHEREAS, the form of the Acknowledgment of Receipt of Appraisal Reports <br />Temporary Construction License granting said temporary construction easement attached <br />hereto as Exhibit A, should in all things be approved, and the City Manager should be <br />authorized to execute the same; NOW, THEREFORE, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS: <br /> <br />Section 1. That the findings set out in the preamble of this resolution are hereby in <br />all things approved. <br /> <br />Section 2. That the offer of the appraised value to the City of Paris for temporary <br />construction easements on two parcels of land owned by the City of Paris, being Parcel 19 <br />TE consisting of a 0.024 acre (1,035 SF) tract ofland in easement, situated in Lamar County <br />Texas, part of the George W.
