<br />RESOLUTION NO. 2004-102
<br />
<br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
<br />PARIS, TEXAS, APPROVING CHANGE ORDER NO. THREE AND FINAL
<br />TO CONTRACT #1 WITH mLLIARD AND SONS CONTRACTORS, INC.
<br />FOR CONSTRUCTION OF THE SOFTBALL FIELDS FOR THE PARIS
<br />SPORTS COMPLEX; MAKING OTHER FINDINGS AND PROVISIONS
<br />RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, the City Council of the City of Paris did heretofore, on the 8th day of May,
<br />2003, in Resolution No. 2003-081, award Contract #1 for construction of the softball fields for
<br />the "Paris Sports Complex," to Hilliard and Sons Contractors, Inc.; and,
<br />
<br />WHEREAS, MHS Planning & Design, acting as project engineer, recommends the
<br />amendment of the contract for said project by Change Order No. Three, to delete hydro mulching,
<br />lime, fertilizer and grass grow-in from four softball fields and to delete hydro mulching, lime,
<br />fertilizer and grass grow-in from the pavilion area, and providing for a net decrease of $16,710.00
<br />in the contract price; and,
<br />
<br />WHEREAS, the form of Change Order No. Three and Contractor's Affidavit of Pinal
<br />Payment and Release, attached hereto as Exhibits A and B, should, in all things, be approved, and
<br />the Mayor should be authorized to execute the same; NOW, THEREFORE,
<br />
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
<br />TEXAS:

<br />Section 1. That the findings set out in the preamble of this resolution are hereby in all
<br />things approved.
<br />
<br />Section 2. That the form of Change Order No. Three to Contract #1 with Hillard and Sons
<br />Contractors, Inc. for construction of softball fields for "The Paris Sports Complex," attached
<br />hereto as Exhibit A, to delete hydro mulching, lime, fertilizer and grass grow-in from four softball
<br />fields and to delete hydro mulching, lime, fertilizer and grass grow-in from the pavilion area, and
<br />providing for a net decrease of $16,710.00 in the contract price, be, and the same is hereby,
<br />approved.
<br />
<br />Section 3. That the Mayor be, and he is hereby, authorized and directed to execute, on
<br />behalf of the City of Paris, said Change Order No. Three, upon the terms and conditions and in
<br />the form shown in Exhibit A attached hereto.
<br />
<br />Section 4. That the Contractor's Affidavit of Final Payment and Release to Contract #1
<br />with Hillard and Sons Contractors, Inc. for construction of softball fields for "The Paris Sports
<br />Complex," attached hereto as Exhibit B, be, and the same is hereby, approved.
<br />
<br />Section 4. That this resolution shall be effective from and after the date of passage.
