<br />RESOLUTION NO. 2004-077
<br />
<br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
<br />PARIS, TEXAS, APPROVING CHANGE ORDER NO. ONE TO
<br />CONTRACT #2 WITH RICHARD DRAKE CONSTRUCTION FOR
<br />SOFTBALL FIELD FENCING INCLUDING CHAIN LINK FENCING,
<br />BACKSTOP AND DUGOUTS FOR THE PARIS SPORTS COMPLEX;
<br />MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE
<br />SUBJECT; AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, the City Council of the City of Paris did heretofore, on the 8th day of May,
<br />2003, in Resolution No. 2003-080, award Contract #2 for softball field fencing including chain
<br />link fencing, backstop and dugouts for the "Paris Sports Complex," to Richard Drake
<br />Construction; and,
<br />
<br />WHEREAS, MHS Planning & Design, acting as project engineer, recommends the
<br />amendment of the contract for said project by Change Order No. One, to install six 2" x 2" steel
<br />columns at each dugout to create better fence to column connections at each dugout (8 dugouts @
<br />+ $600 each), and to substitute pine decking on the dugout roof in lieu of pressure treated pine (8
<br />@ -$65 each), and providing for a net increase of $4,280.00 in the contract price, for a total
<br />contract price of $126,011.66; and,
<br />
<br />WHEREAS, the form of Change Order No. One, attached hereto as Exhibit A should, in
<br />all things, be approved, and the Mayor should be authorized to execute the same; NOW,
<br />THEREFORE,

<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
<br />TEXAS:
<br />
<br />Section 1. That the findings set out in the preamble of this resolution are hereby in all
<br />things approved.
<br />
<br />Section 2. That the form of Change Order No. One to Contract #2 with Richard Drake
<br />Construction for softball field fencing, including chain link fencing, backstops, and dugouts for
<br />"The Paris Sports Complex," attached hereto as Exhibit A, to install six 2" x 2" steel columns at
<br />each dugout to create better fence to column connections at each dugout (8 dugouts @ + $600
<br />each), and to substitute pine decking on the dugout roof in lieu of pressure treated pine (8 @ -$65
<br />each), and providing for a net increase of $4,280.00 in the contract price, for a total contract price
<br />of $126,011.66, be, and the same is hereby, approved.

<br />Section 3. That the Mayor be, and he is hereby, authorized and directed to execute, on
<br />behalf of the City of Paris, said Change Order No. One, upon the terms and conditions and in the
<br />form shown in Exhibit A, attached hereto.
