<br /> <br /> <br /> <br /> ARTICLE III <br /> PROPERTY RIGHTS IN THE COMMON AREAS <br /> <br />Section 1. Owner's Easements of Enjoyment. Every owner shall have a right <br />and easement of enjoyment in and to the Common Area which shall be appurtenant <br />to and shall pass with the title to every Lot, subject to the following provisions: <br /> <br />(a) The right of the Association to charge reasonable admission and other fees <br /> for the use of any recreational facility situated upon the Common Area; <br /> <br />(b) The right of the Association to adopt and enforce rules and regulations for <br /> the use of the Common Areas and recreational facilities; <br /> <br />(c) The right of the Association to suspend the voting rights and the right to use <br /> of the Common Area and recreational facilities by an Owner for any period <br /> not to exceed 60 days for each infraction of its rules and regulations; <br /> <br />(d) The right of the Association to dedicate or transfer all or any part of the <br /> Common Area to any public agency, authority, or utility for such purposes <br /> and subject to such conditions as may be agreed to by the members. No <br /> such dedication or transfer shall be effective unless an instrument signed by <br /> two-thirds (2/3) of the total number of members agreeing to such dedication <br /> of transfer has been recorded in the Real Property Records of Lamar County. <br /> <br />(e) The right of the Association, in accordance with its By-Laws, to borrow <br /> money for the purpose of improving the Common Area and facilities and in <br /> aid thereto or to mortgage said Common Areas and the rights of such <br /> mortgage in such Common Area shall be subordinate to the rights of the <br /> property owners hereunder. <br /> <br />Section 2. Delegation of Use. Any owner may delegate, in accordance with the <br />By-Laws and the Rules and Regulations of the Association, its right of enjoinment to <br />the Common Area and facilities to the employees of his company, his tenants, or <br />contractors who are employed on the property. <br /> <br />Section 3. Owner's Use. Owners' use of their lot and the Common Areas are <br />subject to the provisions of the Articles herein regarding common scheme <br />restrictions, architectural control, party walls, exterior maintenance, and all other <br />articles herein.
