RESOLUTION NO. 2009-032 A RESOLUTIOIV OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING CHANGE ORDER N0. ONE TO THE CONTRACT FOR THE CONSTRUCTION OF THE TRAIL DE PARIS 0.8 MILE EASTERN TRAIL EXTENSION PROJECT; MAKING OTHER FIIVDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris did heretofore, on the 25th day of August, 2008, in Resolution No. 2008-068, award the contract for "Trail de Paris 0.8 Mile Eastern Trail Extension Project,", to Richard Drake Construction Company of Paris, Texas; and, WHEREAS, the City Engineer, Shawn Napier, acting as project engineer, recommends the amendment of the contract for said project based on the actual materials used, and providing for a net decrease of $2,855.61 in the contract price, for a revised contract price of $108,106.83; and, WHEREAS, the form of Change Order No. One, attached hereto as Exhibit A, should, in all things, be approved, and the City Manager should be authorized to execute the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble of this resolution are hereby in all things approved. Section 2. That the form of Change Order No. One to the Contract for the "Trail de Paris 0.8 Mile Eastern Trail Extension Project,", attached hereto as Exhibit A, based on the actual materials used, and providing for a net decrease of $2,855.61 in the contract price, for a revised contract price of $108,106.83, be, and the same is hereby, approved. Section 3. That the City Manager be, and he is hereby, authorized and directed to execute, on behalf of the City of Paris, said Change Order No. One, upon the terms and conditions and in the form shown in Exhibit A, attached hereto. Section 4. That this resolution shall be effective from and after the date of passage.
