DRAFT <br />attorney\reswork\current\Easement-ROW Abandonment 4`" SW Res 2009 <br />RESOLUTION NO. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />DECLARING A PORTION OF A CERTAIN SEWER EASEMENT LOCATED ON AND <br />ACROSS PROPERTY BELONGING TO ROGERS-WADE MANUFACTURING <br />COMPANY IS NO LONGER NEEDED AND IS OF NO USE TO THE CITY OF PARIS; <br />ABANDONING THAT PORTION OF SAID SEWER EASEMENT; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE ANY AND ALL DOCUMENTS NECESSARY <br />TO ABANDON SAID SEWER EASEMENT; MAKING OTHER FINDINGS AND <br />PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE <br />DATE. <br />WHEREAS, it has been determined by the City of Paris that the a portion of a certain <br />sewer easement contained in Right-of-Way Deed from Sallie Lee Lightfoot to City of Paris <br />attached hereto as Exhibit A is located on and across property belonging to Rogers-Wade <br />Manufacturing Company, as shown in the Survey attached hereto as Exhibit B, and is no longer <br />needed by the City of Paris for sewer line purposes; and, <br />WHEREAS, it has been determined that this easement is no longer needed by citizens of <br />Paris for sewer line purposes, and the same should be abandoned; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF PARIS: <br />Section 1. That the findings set out in the preamble of this resolution are hereby in all <br />things approved. <br />Section 2. That the portion of that certain sewer easement located on and across <br />property belonging to Rogers-Wade Manufacturing Company, described in the Sewer Easement <br />Abandonment attached hereto as Exhibit C be, and the same is hereby, declared to be no longer <br />needed by the citizens of the City of Paris for sewer line purposes. <br />Section 3. That the above described portion of a certain sewer easement, is hereby <br />abandoned and the City Manager be, and is hereby directed to execute the Sewer Easement <br />Abandonment attached hereto as Exhibit C and any other documents necessary to abandon such <br />portion of sewer easement. <br />Section 4.
