TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS HOME PROGRAM HOIVIE CONTRACT # 1001053 WITH CITY OF PARIS, A POLITICAL SUBDIVISION OF THE STATE OF TEXAS CFDA 14.239 HOME 1NVESTMENT PARTNERSHIPS PROGRAM Awarding Federal Agency: U.S. Department of Housing and Urban Development Award Number: M-06-SG-48-0100 Award Year: 2008 HUD Entity Type: State Recipient This contract and agreement ("Contract") in connection with a HOME Investment Partnerships Program award is made and entered into by and between the TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS, a public and official agency of the State of Texas, hereinafter referred to as "Department," and CITY OF PARIS, A Political Subdivision of the State of Texas ("Administrator"), herein collectively referred to as "Parties." For and in consideration of the promises herein made, and the mutual benefits derived and to be derived, the parties hereto agree and by execution hereof are bound to the mutual obligations and to the performance and accomplishment of the tasks which are the substance of this contract. SECTION 1. CONTRACT PERIOD: This contract shall be effective and commence on the date the Department's Executive Director executes the contract and shall terminate TWENTY-TWO (22) months from the effective date, unless otherwise specifically provided herein ("Contract Period"). SECTION 2. ADMINISTRATOR PERFORMANCE: Administrator agrees to administer an Owner Occupied Housing Assistance Program award in accordance with the HOME Investment Partnerships Act of 1990, 42 U.S.C. 12721-12839 (the "Act"); applicable Federal and CPD Notices issued by HUD; implementing regulations, 24. C.F.R. Part 92; Tex. Gov't Code Ann. Chapter 2306 (Vernon 2003), the HOME Program Rules, 10 TAC §53 et seq. (the "2008 HOME Rules"), adopted December 20, 2007, the HOME Program Manuals ("HOME Manual") and the Application and Application Submission Procedures Manual. Administrator agrees to perform all activities in accordance with the terms of the Performance Statement and Budget attached hereto as Exhibit A; the Applicable Laws and Regulations attached hereto as Exhibit B; the Certifications attached hereto as Exhibit C; al1 such Exhibits incorporated herein for all relevant purposes; the assurances, certifications, and all other statements made by Administrator in its application for the project funded under this contract; and with all other terms, provisions, and requirements herein set forth. i ArI - A
