Brady Environmental Services, Inc. <br />b.) All the work and all materials and equipment to be incorporated therein, whether in <br />storage on or off the site, under the care, custody or control of the contractor or any <br />of its subcontractors or sub-subcontractors; and <br />c.) Other property at the site ar adjacent thereto, including trees, shrubs, lawns, walks, <br />pavements, roadways, structures and utilities not designated for removal, relocation <br />or replacement in the course of performance of these services. <br />2.81 The contractor shall give all notices and comply with all applicable laws, <br />ordinances, rules, regulations and lawful orders of any public authority <br />bearing on the safety of persons or property or their protection from <br />damage, asbestos exposure, injury or loss. <br />These rules and regulations include, but are not limited to: <br />• EPA's National Emissions Standards for Hazardous Air Pollutants <br />(NESHAPS) 40 CFR Part 61, Sub-parts A and M <br />• Texas Department of State Health Services concerning Texas Asbestos <br />Health Protection Act <br />• EPA's final Asbestos Rules, 40 CFR Part 763 (AHERA) <br />• OSHA's final Asbestos Rules, for the construction industry, found at 29 <br />CFR Section 1926.1101, and following; and where applicable, for general <br />industry, found at 29 CFR 1910.1001 and following <br />2.8.2 The contractor shall erect and mainfain, as reyuired by existing conditions <br />and progress of the work, all reasonable safeguards for safety and <br />protection, including posting danger signs and other warnings against <br />hazards, promulgating safety regulations and notifying owners and users <br />of adjacent utilities. <br />2.8.3 The contractor shall promptly remedy all damage or loss to any property <br />caused in whole or in part by the contractor, any subcontractor, and sub- <br />subcontractor, or anyone directly or indirectly employed by any of them, <br />or by anyone for whose acts any of them may be liable and for which the <br />contractor is responsible. <br />2.9 - MODIFICATIONS The owner may, at its sole option and without invalidating the <br />contract, arder modifications of the work which might include increases or decreases in <br />the amount of the work. Authorization to proceed with this modification shall be by the <br />issuance of a properly authorized supplemental purchase order. <br />4of17 <br />
