A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING AND ACCEPTING THE TERMS AND CONDITIONS OF A WATER SERVICE CONTRACT BY AND BETWEEN THE CITY OF PARIS AND MARVIN-JENNING-CLARDY WATER CORPORATION FOR THE SALE OF POTABLE WATER; AUTHORIZING ITS EXECUTION BY THE CITY MANAGER; MAKING OTHER FINDIIVGS AND PROVISIOIVS RELATED TO THE SUBJECT; A1VD PROVIDIIVG AN EFFECTIVE DATE. WHEREAS, the City of Paris has been since 1990 furnishing water to Marvin- Jennings-Clardy Water Corporation (MJC) under the terms of a Water Service Contract; and, WHEREAS, the Water Service Contract with MJC has expired and the City Council of the City of Paris did heretofore authorize the negotiation of a new Water Service Contract between the City of Paris and JMC; and, WHEREAS, upon full review and consideration of the Agreement, and all matters attendant and related thereto, the City Council is of the opinion that the terms and conditions thereof should be approved, and that the City Manager, shall be authorized to execute it on behalf of the City of Paris. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, THAT: Section 1. The findings set out in the preamble to this resolution are hereby in all things approved. Section 2. The terms and conditions of the Agreement, having been reviewed by the City Council of the City of Paris and found to be acceptable and in the best inerests of the City of Paris and its citizens, are hereby in all things approved. Section 3. The City Manager, is hereby authorized to execute the Agreement and all other documents in connection therewith on behalf of the Ciry of Paris, substantially according to the terms and conditions set forth in the Agreement attached hereto as Exhibit «A» Section 4. This resolution shall become effective immediately upon its passage.
