After reviewing the petition, staff has determined that it contains 11 of the 14 signatures from neighbors in <br />the vicinity of the requested change, with 78 percent of adjoining property owners as described in Section <br />21-105 above having signed the petition. <br />The Comprehensive Plan recommends that this property be used for Low Density Residential purposes; <br />therefore, approval of this request would be contingent upon the City Council approving the related <br />amendment to the Future Land Use Plan Map to allow for High Density Residential uses, which action <br />precedes this item on the agenda. <br />The development of this property will have to meet City and State standards for development which <br />includes: utility installation, grading and drainage. By law the property must accept the water that is <br />currently flowing across and cannot release more that what was flowing to the downstream neighbor. This <br />will most likely dictate that a detention pond be constructed with this development. <br />On April 6, 2009, the Planning and Zoning Commission recommended that the City Council approve the <br />requested change to Planned Development District (PD-b) Housing Development or Community Unit <br />Development and several people spoke in opposition to this item. A related agenda item (no. 16) precedes <br />this request. The property owner has requested another delay in Council action until July 20 due to an <br />"unforeseen condition." Our procedures do not have a deadline for Council action on this type of item but <br />almost without exception Council acts on P&Z items the first council meeting after P&Z makes a <br />recommendation. Since the latest rescheduling request will make a Council decision a 107 days after <br />P&Z's recommendation, staff did not feel it appropriate to grant the request administratively since it was so <br />unusual compared to the City's historical practice.
