RESOLUTION NO. 2009-Q64 _ <br />A RESOLUTION OF THE CITY COUIIICIL OF THE CITY OF PARIS, TEXAS, <br />DECLARING AS SURPLUS PROPERTY OUTDATED AND UNUSED OLD <br />STYLE SELF CONTAINED BREATHING APPARATUS WHICH HAVE BEEN <br />REMOVED FROM SERVICE; APPROVIIVG THE SALE OF SAID EQUIPMEIVT <br />TO HAZ-CO IN EXCHANGE FOR FIRE ACADEMY TRAINING FOR THREE <br />1VEW RECRUITS; MAKING OTHER FINDINGS AND PROVISIONS RELATED <br />TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. <br />WHEREAS, the Fire Department has many outdated and unused old style self <br />contained breathing apparatus ("SCBA") which have been removed from service and are no <br />longer being used by the City of Paris Fire Department; and, <br />WHEREAS, the old SCBA units no longer meet the State of Texas requirements for a <br />front-line engine and the Paris Fire Department switched over to the new style Scott SCBA <br />units several years ago so; and, <br />WHEREAS, the old MSA SCBA units still have value to fire training academies, but <br />should be declared to be surplus property to the City of Paris and disposed of in accordance <br />with state law; and, <br />WHEREAS, HAZ-C0, a fire training academy in Grayson County, Texas still uses this <br />rype of MSA SCBA for training purposes, and HAZ-CO has offered free fire academy training <br />for three new recruits of Paris Fire Department personnel (approximately $6,000 value) in <br />return for the City's donation to HAZ-CO of the old MSA - SCBA units; and, <br />WHEREAS, it is deemed to be in the best interests of the citizens of the Ciry of Paris <br />that the old MSA SCBA units be declared surplus and sold to HAZ-C0. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS: <br />Section 1. That the findings set out in the preamble to this resolution are hereby <br />in all things approved. <br />Section 2. That the old MSA SCBA units, be, and the same are hereby, declared to <br />be surplus property; and, <br />Section 3. That the sale of the old MSA SCBA units to HAZ-CO in consideration for <br />fire academy training for three new recruits or Paris Fire Department personnel at no cost <br />to the City of Paris, be, and the same is hereby, approved. <br />Section 4. That this resolution shall be effective from and after its date of <br />passage. <br />
