(5) Description of the relief requested. <br />(6) Period of time for which the variance is sought. <br />(7) Alternative water use restrictions or other measures the petitioner is <br />taking or proposes to take to meet the intent of this Plan and the <br />compliance date. <br />(8) Other pertinent information. <br />(c) Variances granted by the City of Paris shall be subject to the following <br />conditions, unless waived or modified by the City Manager, or his authorized <br />designee: <br />(1) Variances granted shall include a timetable for compliance; <br />(2) Variances granted shall expire when the Plan is no longer in <br />effect, unless the petitioner has failed to meet specified <br />requirements. <br />(d) No variance shall be retroactive or otherwise justify any violation of this <br />Plan occurring prior to the issuance of the variance. <br />"Sec. 34 -162 Contracted Sales of Water <br />The provisions of this Article and the Drought Contingency Plan adopted <br />hereby shall be subject to and construed in a manner consistent with the provisions <br />of outstanding water supply contracts and the contractual obligations of the City of <br />Paris thereunder to supply water under the terms of said contracts to retail or <br />wholesale purchasers. This Section applies only to contracted sales of water to <br />customers under written contracts approved by the City Council of the City of Paris <br />and does not apply to purchases of water by customers under the City's rate <br />ordinances." <br />Section 3. That Article V, entitled "Drought Contingency Plan for Wholesale Water <br />Customers," of Chapter 34 of the Code of Ordinances of the City of Paris, Texas, is hereby <br />amended in its entirety to read as follows: <br />"Article V. Drought Contingency Plan for Wholesale Water Customers <br />"Sec. 34 -170. Declaration of Policy, Purpose, and Intent <br />In order to conserve the available water supply and /or to protect the <br />integrity of water supply facilities, with particular regard for domestic water use, <br />sanitation, and fire protection, and to protect and preserve public health, welfare, <br />and safety and minimize the adverse impacts of water supply shortage or other <br />water supply emergency conditions, the City of Paris adopts the following Drought <br />Contingency Plan for wholesale water customers (the Plan). <br />19 <br />
