MINUTES OF THE FIRE AND BUILDING CODE REVIEW COMMITTEE <br />C1TY COUNCIL CHAMBER <br />107 E. KAUFMAN STREET, PARIS, TEXAS <br />DECEMBER 8, 2009 <br />5:00 O'CLOCK P.M. <br />1. Call meeting to order. <br />Chainnan Waldrum called the meeting to order at 5:00 p.m. The following members were <br />present: Gary Brown, Mike Davenport, John Fuston, Bryan Hargis, Jerry Haning, Johnny <br />Norris, Bobby Smallwood, Kim Stephens, and Carolyn Whelchel. Council Members Kear and <br />Pickle were present. Also, present were city staff Janice Ellis, Ronnie Grooms, Dale Mayberry, <br />and Shawn Napier. City Manager Kevin Carruth and City Attorney Kent McIlyar were attending <br />a Paris Economic Development Corporation meeting. <br />2. Deliberate and review of the Fire and Building Codes. <br />Chairman Waldrum said that he had been researching as to whether or not cities could be <br />held liable for not enforcing their own rules and it was his conclusion that government entities <br />could not be held liable for discretionary decisions. Chainnan Waldrum said there was a federal <br />case that he planned to review for verification. <br />Chairman Waldrum inquired if there were any historic structures that were not located in <br />a historic district. Carolyn Whelchel said there were several properties, such as the Magnolia <br />House and Cane River. Chairman Waldrum said that those stand-alone historic structures should <br />be included on a list with the structures that are located in historic districts. John Fuston said that <br />he thought the Chamber of Coirunerce had a listing of historical properties. Shawn Napier told <br />the Committee there were several overlay districts that had been created for stand-alone <br />historical structures. <br />Chairman Waldrum stated that the Fire Code allowed cities to make their own rules <br />regarding historic districts. Bobby Smallwood asked that Chief Grooms and Dale Mayberry <br />bring suggestions to the Committee for review regarding a fire plan/rules for historic structures. <br />Several committee members expressed a desire to review fire plans/rules that have been <br />implemented by other cities for historic districts. They asked that staff include that information <br />with their suggestions. <br />Chairman Waldrum referred the Cornmittee to the proposed Ordinance and they began <br />reviewing Article III. The Committee concurred that the words "2006 Fire" should be added to <br />the Title. The Committee continued their review of the Ordinance and made the following <br />suggestions: <br />Section 12-52(b) delete International Building Code. <br />rn~nn~ <br />
