Section 7.5 Possession of the Property shall be delivered to Purchaser by <br />Seller at the Ciosing, subject only to the Permitted Exceptions and such rights of others <br />as have been expressly disclosed herein. <br />Section 7.6 Except as otherwise provided herein, all costs and expenses in <br />connection with the transaction contemplated by this Contract shail be borne by <br />Purchaser. Selier and the Purchaser shall pay its own attorneys' fees; provided, <br />however, in the event of any litigation arising hereunder, the prevailing party shall be <br />entitled to recover, as part of any judgment rendered, reasonable attorneys' fees and <br />costs of suit. <br />ARTICLE 8 <br />Real Estate Commission <br />Section 8.1 Each party hereto represents and warrants to the other party that it <br />has not empioyed any broker or real estate agent in connection with the transaction <br />contemplated by this Contract. <br />ARTICLE 9 <br />Remedies of Default <br />Section 9.1 In the event all conditions of this Contract are satisfied by <br />Purchaser (if Purchaser's obligation) or waived and in the event all covenants and <br />agreements to be performed by Purchaser prior to Closing are fully performed, and in <br />the event that performance of this Contract is tendered by the Purchaser and the s <br />not consummated through default on the part of the Seller on the Closing Date, then <br />Purchaser shall be entitled to enforce specific performance hereunder. The remedies <br />set forth in this Section 9.1 shall be Purchaser's sole remedies. Nothing herein shall be <br />construed to limit Purchaser's right and power of eminent domain. <br />Section 9.2 In the event of Purchaser's default hereunder, Seller shall be <br />entitled to terminate this Contract, or enforce special performance hereunder. The <br />remedies set forth in this Section 9.2 shall be Seller's sole remedies. <br />ARTICLE 10 <br />Miscellaneous <br />Section 10.1 Any notice or communication required or permitted hereunder shall <br />be given in writing, sent by (a) personal delivery (provided that such delivery is <br />confirmed by the courier delivery service), or (b) expedited delivery service with proof of <br />delivery, or (c) United States Mail, postage prepaid, registered or certified mail, or (d) <br />prepaid telegram or telex (provided that such telegram or telex is confirmed by <br />REAL ESTATE CONTRACTITO CITY PAGE 6 <br />(No Earnest Money) (Inspection Fee) <br />
