2010-046 RES ACCEPTANCE OF PROPOSAL OF WHITAKER HOMES TO CONSTRUCT UP TO FIVE NEW SINGLE HOMES IN PARIS UNDER GRANT

RESOLUTION NO. 2010-046 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ACCEPTING THE PROPOSAL OF WHITAKER HOMES TO CONSTRUCT UP TO FIVE NEW SINGLE FAMILY HOMES IN THE CITY OF PARIS, TEXAS UNDER THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS HOME OWNER-OCCUPIED PROGRAM GRANT CONTRACT N0. 1001053; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBjECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris did heretofore, request proposals from building contractors to furnish plant, labor, materials, and equipment, and for performing all work required for the construction of up to five (5) new single-family homes in the City of Paris, Texas under the guidelines and requirements of the Texas Department of Housing and Community Affairs HOME Owner-Occupied Program Contract No. 1001053, which bids were received until 10:00 o'clock A.M., Tuesday, the 2nd day of February, 2010; and, WHEREAS, the proposals received were noted and scored in accordance with the Program guidelines and the highest scoring proposal was submitted by Whitaker Homes, 2550 Lamar Ave., Paris, Texas 75460; and, WHEREAS, the proposal submitted by Whitaker Homes to build up to five new single family homes should be accepted as the best proposal providing the best value to the City of Paris and a contract should be awarded to Whitaker Homes in accordance with the unit price submitted and the other terms and conditions set out in the proposal documents attached hereto as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble of this resolution are hereby in all things approved. Section 2. That the proposal of Whitaker Homes of Paris, Texas, for the "TDHCA HOME Owner-Occupied Program Contract No. 1001053 housing construction builder, is hereby accepted as the highest scoring proposal which provides the best value to the City and the contract for this project is hereby let conditioned upon said contractor's execution of a contract with the City of Paris and satisfaction of the terms and specifications included in the contract and proposal documents attached hereto as Exhibit A and providing all required performance and payment bonds and insurance certificates as required. Section 3. That the City Manager be and he is hereby authorized and directed to execute on behalf of the City of Paris a contract for the housing construction builder in the form attached hereto and incorporated herein as Exhibit A. Section 4. That this resolution shall be effective from and after its date of passage. PASSED AND APPROVED this 12t'' day of April, 2010.
