RESOLUTION NO. 2010-064 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />APPROVING CHANGE ORDER NO. ONE, FINAL PAYMEIVT AND CLOSING OUT OF <br />THE CONTRACT FOR THE WATER AND WASTEWATER CAPITAL IMPROVEMENT <br />PHASE II 2009 IN THE CITY OF PARIS; MAKING OTHER FINDINGS AND <br />PROVISIONS RELATED TO THE SUBJECT; AND DECLARING A1V EFFECTIVE DATE. <br />WHEREAS, the City Council of the City of Paris did heretofore, on the 13th day of July, 2009, <br />in Resolution No. 2009-072, award the contract for the "Water and Wastewater Capital <br />Improvements Phase 112009" which consisted of replacement of the Culbertson Street Water Line, <br />the Cleveland Street Sewer Line and the Washington Street Sewer Line to B. Bray Construction <br />Company of Paris, Texas; and, <br />WHEREAS, the City Engineer recommends that Change Order No. One, attached hereto as <br />Exhibit "A" be approved, final payment be made and the closing of the contract for said project be <br />accepted based upon the completion of said water and sewer construction project; and, <br />WHEREAS, Change Order No. One, the final payment to B. Bray Construction Company and <br />the closing of said construction contract should, in all things, be approved and the City manager <br />should be authorized to execute any necessary documents. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, <br />TEXAS: <br />Section 1. That the findings set out in the preamble of this resolution are hereby in all <br />things approved. <br />Section 2. That Change Order No. One, the final payment to B. Bray Construction Company <br />be approved and the closing of the Contract for the Water and Wastewater Capital improvement <br />Phase II 2009" be accepted upon receipt of an executed Final Payment and Release of All Claims <br />Affidavit by B. Bray Construction Company. <br />Section 3. That the City Manager be, and he is hereby, authorized and directed to <br />execute, on behalf of the City of Paris, Change Order No. One attached hereto as Exhibit "A". <br />Section 4.
