TEXAS DEPARTMENT OF HOUSING COMMUNITY AFFAIRS <br />HOME INVESTMENT PARTNERSHIPS PROGRAM <br />RESERVATION SYSTEM PARTICIPANT ("RSP") AGREEMENT <br />RSP AGREEMENT # 2010-0015 <br />WITH THE <br />CITY OF PARIS, <br />A POLITICAL SUBDIVISION OF THE STATE OF TEXAS <br />HOME RSP AGREEMENT (this "Contract") in connection with approval to participate in the <br />HOME Investment Partnerships Program (CFDA 14.239) Reservation System is made and <br />entered into by and between the TEXAS DEPARTMENT OF HOUSING AND <br />COMMUNITY AFFAIRS, a public and official agency of the State of Texas, hereinafter <br />referred to as "Denartment," and the CITY OF PARIS, a Political Subdivision of the State of <br />Texas ("RSP"), herein collectively referred to as "Parties." <br />RECITALS <br />WHEREAS, the Department has entered into a grant agreement with the U.S Department <br />of Housing and Urban Development ("HUD") pursuant to which HUD will provide funds to <br />TDHCA to make available to eligible applicants in accordance with the Program Requirements; <br />WHEREAS, the Department is a designated Participating Jurisdiction within the meaning <br />of the 24 C.F.R. Part 92 and has the authority to make a subaward or otherwise contract with <br />eligible organizations to participate in the administration of HOME funds (the "HOME Funds") <br />to eligible applicants in accordance with the Program Requirements; <br />WHEREAS, the Board adopted Title 10 of the Texas Administrative Code (TAC) <br />Chapter 53, effective September 24, 2010, applicable to this Contract ("HOME Rule") which set <br />forth, among other things, the rules and reyuirements by which the Department will administer <br />the HOME Funds; <br />WHEREAS, the Executive Director approved the Department to enter into this Contract <br />subject to the terms and conditions set forth herein to RSP to serve Households under the <br />Reservation System; and <br />WHEREAS, RSP agrees to participate in the Reservation System and administer HOME <br />Funds in accordance with the HOME Investment Partnerships Act of 1990, 42 U.S.C. 12721- <br />12839 (the "Act"); applicable Federal and CPD Notices issued by HUD; implementing <br />regulations, 24. C.F.R. Part 92; Tex. Gov't Code Ann. Chapter 2306 (Vernon 2003), 10 TAC <br />Chapter 53 et seq. (the "HOME Rule"), the Application and Application Submission Procedures <br />Manual, and the terms of this Contract and all exhibits and attachments hereto, collectively <br />referred to as "Program Requirements". <br />1 of 25 2010-0015 <br />66 <br />
