DRAFT <br />S:\RESWORK\CURRENT\Smith Creek Bridge Project - Final Pymt & Closing Contract Spann Concrete - RES 2010.docx <br />RESOLUTION N0. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />APPROVING FINAL PAYMENT AND CLOSING THE CONTRACT FOR THE <br />SMITH CREEK BRIDGE REPLACEMENT PROJECT, TO SPANN CONCRETE <br />CONSTRUCTION, LLC; MAKING OTHER FINDINGS AND PROVISIONS <br />RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. <br />WHEREAS, on June 14, 2010, the City Council of the City of Paris passed Resolution <br />No. 2010-068, awarding the contract for the construction of the Smith Creek Bridge <br />Replacement Project to Spann Concrete Construction, LLC, of Paris, Texas; and, <br />WHEREAS, the bridge is complete and has been inspected and approved and the <br />City Engineer recommends that the contract now be closed upon receipt of an executed <br />Affidavit of Final Payment and Release of All Claims; and, <br />WHEREAS, the final payment to Spann Concrete Construction, LLC in the amount of <br />$15,035.47 should, in all things, be approved and the City manager should be authorized to <br />execute any necessary documents. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, TEXAS: <br />Section 1. That the findings set out in the preamble of this resolution are hereby <br />in all things approved. <br />Section 2. That final payment to Spann Concrete Construction, LLC in the <br />amount of $15,035.47 be approved and the closing of the Contract for the construction <br />project at the Smith Creek Bridge Replacement Project be accepted upon receipt of an <br />executed Final Payment and Release of All Claims Affidavit by Spann Concrete <br />Construction, LLC. <br />Section 3. That the City Manager be, and he is hereby, authorized and directed to <br />execute, on behalf of the City of Paris, any necessary documents. <br />Section 4. That the Director of Finance be, and he is hereby, authorized and <br />directed to distribute funds for purposes of final payment and closing of the contract. <br />Section S.
