AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS FINDING THAT PUBLIC NECESSITY AND CONVENIENCE REQUIRE THE CITY COUNCIL TO GRANT A PRIVILEGE TO USE THE CITY STREETS, HIGHWAYS, ALLEYS AND THOROUGHFARES TO COLLECT AND TRANSPORT SOLID WASTE FROM RESIDENTIAL ACCOUNTS WITHIN THE CITY LIMITS OF THE CITY OF PARIS, TEXAS; AWARDING A CONTRACT FOR THE COLLECTION AND TRANSPORTATON OF SOLID WASTE FOR RESIDENTIAL ACCOUNTS IN THE CITY; ESTABLISHING A STREET USE FEE; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND PREPARE ALL NECESSARY DOCUMENTS TO EFFECTUATE THIS ORDINANCE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, pursuant to Section 124 of the Paris City Charter, the City Council of the City of Paris may grant a privilege to any person or corporation to use the City streets, highways, alleys and thoroughfares of the City to collect and transport solid waste upon a showing of a public necessity and convenience and upon passage of an ordinance by a two-thirds majority vote of the City Council; and WHEREAS, on September 30, 2010 the City of Paris sent out a Request for Proposals for solid waste landfill services and residential solid waste collection services requesting that proposals be submitted no later than October 28, 2010; and WHEREAS, the City received proposals from five different companies for either landfill services, residential solid waste collection services, or a combination of both, and the City Council has reviewed and studied these proposals over the last two and one-half months; and WHEREAS, on November 15, 2010, the City Council called a special meeting to conduct a workshop to review and discuss the proposals in more detail and on November 22, 2010, the City Council called a public hearing to receive input and comment from the public about the landfill services proposals and the residential solid waste collection proposals; and WHEREAS, the City Council having reviewed, discussed and deliberated the proposals submitted for residential solid waste collection services and having received input from the citizens of Paris at Public Hearing and upon a finding of public necessity and convenience for privatizing solid waste collection services for residential accounts in the City of Paris, the City Council hereby finds by a two-thirds majority vote of the City Council that has submitted the best proposal for residential solid waste collection services and should be granted the privilege and the right to use the public streets, highways, alleys and thoroughfares way to collect and transport solid waste for residential accounts in the City of Paris, Texas. 79
