DRAFT <br />S:AORDWORK\CURRENT10rdinance Granting Privilege for Residential SW Collection FINAL 2011.docx <br />ORDINANCE NO. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />TEXAS FINDING THAT PUBLIC NECESSITY AND CONVENIENCE <br />REQUIRE THE CITY COUNCIL TO GRANT A PRIVILEGE TO USE <br />THE CITY STREETS, HIGHWAYS, ALLEYS AND THOROUGHFARES <br />TO COLLECT AND TRANSPORT SOLID WASTE FROM <br />RESIDENTIAL ACCOUNTS WITHIN THE CITY LIMITS OF THE CITY <br />OF PARIS, TEXAS; AWARDING A CONTRACT FOR THE <br />COLLECTION AND TRANSPORTATON OF SOLID WASTE FOR <br />RESIDENTIAL ACCOUNTS IN THE CITY; ESTABLISHING A STREET <br />USE FEE; AUTHORIZING THE CITY MANAGER TO NEGOTIATE <br />AND PREPARE ALL NECESSARY DOCUMENTS TO EFFECTUATE <br />THIS ORDINANCE; MAKING OTHER FINDINGS AND PROVISIONS <br />RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE <br />DATE. <br />WHEREAS, pursuant to Section 124 of the Paris City Charter, the City Council of the <br />City of Paris may grant a privilege to any person or corporation to use the City streets, highways, <br />alleys and thoroughfares of the City to collect and transport solid waste upon a showing of a <br />public necessity and convenience and upon passage of an ordinance by a two-thirds majority <br />vote of the City Council; and <br />WHEREAS, on September 30, 2010 the City of Paris sent out a Request for Proposals <br />for solid waste landfill services and residential solid waste collection services requesting that <br />proposals be submitted no later than October 28, 2010; and <br />WHEREAS, the City received proposals from five different companies for either landfill <br />services, residential solid waste collection services, or a combination of both, and the City <br />Council has reviewed and studied these proposals over the last two and one-half months; and <br />WHEREAS, on November 15, 2010, the City Council called a special meeting to <br />conduct a workshop to review and discuss the proposals in more detail and on November 22, <br />2010, the City Council called a public hearing to receive input and comment from the public <br />about the landfill services proposals and the residential solid waste collection proposals; and <br />WHEREAS, the City Council having reviewed, discussed and deliberated the proposals <br />submitted for residential solid waste collection services and having received input from the <br />citizens of Paris at Public Hearing and upon a finding of public necessity and convenience for <br />privatizing solid waste collection services for residential accounts in the City of Paris, the City <br />Council hereby finds by a two-thirds majority vote of the City Council that <br />has submitted the best proposal for residential solid waste collection services and should be <br />granted the privilege and the right to use the public streets, highways, alleys and thoroughfares <br />way to collect and transport solid waste for residential accounts in the City of Paris, Texas. <br />79 <br />
