ORDINANCE N0. 2010-044 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ENACTING A NEW ARTICLE IV, FIRE AND RESCUE SERVICE FEES, TO CHAPTER 12 OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS; PROVIDING FOR THE COLLECTION OF FEES AND COSTS FOR SERVICES RENDERED AT VEHICLE FIRES, VEHICLE ACCIDENTS, HAZARDOUS WASTE SPILLS AND RESCUE INCIDENTS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBjECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Paris Fire Department (the "Department") provides both emergency and non-emergency response within the service area of the City of Paris, Texas; and, WHEREAS, the City of Paris Fire Department is equipped with and utilizes certain apparatus, emergency tools, equipment, and materials as a means of saving laves and property; and, WHEREAS, the persons or entities requiring emergency services from the Department, and for whom the referenced apparatus, tools, equipment, and materials have been utilized, should reimburse the Department a portion of the costs associated with the use, loss, damage and wear and tear to said tools, equipment, and materials incurred in connection with the act of rendering emergency services to said persons or entities; and, WHEREAS, the City Council has determined that it is in the best interest of the City of Paris citizens to recoup the costs incurred by the Fire Department when providing emergency and fire rescue services to persons involved in vehicle fires, accidents, hazardous waste spills, etc. in the City of Paris, Texas, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, THAT: Section 1. The findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. A new Article IV Fire and Rescue Service Fees to Chapter 12 of the Code of Ordinances of the City of Paris, Texas is hereby enacted to read in its entirety as follows:
